MEMORANDUM & ORDER: PROCEDURAL ORDER, AND PRELIMINARY INJUNCTION... Judge: Deakin, Hon. David A Procedural Order No later than July 30, 2020, Stephen L. D'Angelo shall file a supplemental affidavit, which shall set out: 1) The amount, source, and date of any payment(s) of whatever type received by the D'Angelo Law Group and/or any attorney, employee, or other representative of the D'Angelo Law Group in connection with the Columbia Gas class action; 2) The terms of any contingent fee agreement or arrangement for payment for legal services rendered in connection with the Columbia Gas class action and a statement as to whether the D'Angelo Law Group and/or any attorney, employee, or other representative of the D'Angelo Law Group anticipates being paid as a result of the agreement arrangement and , if so, when and how the D'Angelo Law Group anticipates being paid; 3) A listing -- by name, position, and weekly earnings - of the D'Angelo Law Group's weekly payroll from January 1, 2020, to present; and 4) The amount(s) of any draws taken by Stephen L. D'Angelo, Esquire, and/or any other partner, owner, or proprietor of the D'Angelo Law Group from assets of the D'Angelo Law Group in 2018, 2019, and 2020. Should D'Angelo not submit an affidavit or should the affidavit not be fully responsive, the court will issue a notice for D'Angelo to show cause as to why he should not be called before the court to testify more full as to these and related matters. Preliminary Injunction It is hereby ORDERED that if the D'Angelo Law Group, or anyone acting at its direction or on its behalf, receives in any form of payment for the firm's work - including but not limited to the work of any of its owners, principals, attorney, and/or personnel - in connection with the consolidated Columbia Gas class action litigation, in which Acosta et al v. Bay State Gas Company of Mass. et al, 1877CV01343, is the lead case, the D'Angelo Law Group shall place the entirety of those funds in an interest-bearing escrow account and shall not withdraw, dispense, spend, use, or in any other way disturb the balance of the account without prior approval of this court, after notice to the plaintiff-intervenor Jennifer M. Carrion, and an opportunity for her to be heard in opposition, should she so choose. This order applies to funds received by the firm for its work in the case; it does NOT apply to funds received by the firm that are payable to and/or recoverable by clients as damages or other forms of recovery.

ORDER: SCHEDULING ORDER AFTER HEARING ON 7/14/2020 1. Defendant-intervenors' submissions in connection with plaintiff-intervenor's emergency motion for trustee process/reach and apply are due to be filed no later than 4:00pm on 7/30/2020. Said motions shall be sent in via email to Essex.clerksoffice@jud.state.ma.us and shall be directed to the attention of Judge David Deakin. 2. Defendant-intervenors' response to plaintiff-intervenor's petition for attorney's fees in connection with summary judgment decision in favor of plaintiff-intervenor shall be filed no later than 4:00pm on 8/3/2020. Said response shall be sent in via email to Essex.clerksoffice@jud.state.ma.us and shall be directed to the attention of Judge David Deakin. 3. Defendant-intervenors' opposition to plaintiff-intervenor's not-yet-filed motion for trustee process shall be served no later than 7/28/2020. Plaintiff-intervenor shall submit Rule 9A package no later than 7/30/2020. Said motion package shall be sent in via email to Essex.clerksoffice@jud.state.ma.us and shall be directed to the attention of Judge David Deakin. Defendant-intervenors' motion for guidance (paper #101) is therefore moot and will be endorsed as discussed at the motion hearing on 7/14/2020. 4. Final pre-trial conference on claims remaining for adjudication in this case currently scheduled for 7/21/2020 is canceled and rescheduled to 9/10/2020 at 2:00pm. Assistant Clerk Jose Mejia will contact counsel at least two days in advance of hearing with either Zoom invitation or teleconference number. Final pre-trial memorandum shall be filed by email to the attention of Jose Mejia no later than 4:00pm on 9/8/2020. 5. The court will issue an order forthwith reducing its oral orders of 7/14/2020 to writing.

ORDER: DISCOVERY ORDER After a hearing on January 31, 2020, the court enters the following orders. As to the Plaintiff-Intervenor's Motion to Compel Discovery, the defendants shall deliver the following discovery items to counsel for the plaintiff-intervenor no later than March 5, 2020: 1. Copies of checks/payments corresponding to the unidentified deposits of legal fees/income totaling $151,427.56 in the 2016 D'Angelo Law Group, LLC, general ledger, as shown on the Missing Legal Fee Income Chart, appended as Exhibit C to the Plaintiff-Intervenor's Memorandum in Support of Motion to Compel Discovery; 2. Copies of D'Angelo Law Group LLC's balance sheet, profit & loss statements, reconciliation reports, general ledger, and bank statements for Fiscal Years 2017 and 2018; 3. Copies of Defendant Stephen D'Angelo's Tax Summary, Schedule K, W-2, and distribution payments for Fiscal Years 2017 and 2018; 4. Copies of 2018 state and federal tax returns of the D'Angelo Law Group, LLC; and 5. Copies of Stephen D'Angelo's 2018 state and federal tax returns. The plaintiff-intervenor's motion for costs associated with her motion to compel will be the subject of a hearing at the final pretrial conference on March 19, 2020. As to the plaintiff's Motion to Compel Discovery, the parties reported to the court at the hearing on January 31, 2020, that they had reached an agreement regarding the defendant's compliance with outstanding responses to interrogatories. The parties further agreed that the defendant would respond as agreed within 21 days. Thus, the plaintiff's Motion to Compel requires no further action by the court.
