“Actual damages are either general or special. The term ‘general damages’ is applied to loss, damage, or injury which is conclusively presumed to have been foreseen or contemplated by the party as a consequence of his breach of contract or wrongful act, whereas ‘special damages’ signifies injurious consequences which are not deemed as a matter of law to have been foreseen, but which are shown to have been contemplated or anticipated by the parties.” (Nelson v. Data Terminal Systems (1989) 762 S.W.2d 744, 748 citing First National Bank of Hico v. English (1951) 240 S.W.2d 503, 507.)
“Actual damages for fraud, including either the benefit-of-the-bargain measure or the out-of-pocket measure, need not be explicitly pleaded because they are direct, general damages from the fraud, rather than special damages.” (Myers v. Walker (2001) 61 S.W.3d 722, 730 citing Green v. Allied Interests, Inc. (1998) 963 S.W.2d 205, 208.)
General damages are non-economic damages that do not require any special pleading to recover them. General damages include compensation for injury to character or reputation, injury to feelings, mental anguish, and similar wrongs suffered by the plaintiff. (Waste Mgmt. v. Tex. Disposal Sys. Landfill, Inc. (2014) 434 S.W.3d 142, 155.)
“While a defamatory statement is one that tends to injure a person's reputation, such a statement is defamatory per se if it injures a person in her office, profession, or occupation. The common law deems such statements so hurtful that the jury may presume general damages (such as for mental anguish and loss of reputation).” (Hancock v. Variyam (2013) 400 S.W.3d 59, 62.)
“[E]ven though Texas law presumes general damages when the defamation is per se and involves a matter of private concern, it does not presume ‘any particular amount of damages beyond nominal damages.’” (Salinas v. Salinas (2012) 365 S.W.3d 318, 320.) “However, even if some mental anguish can be presumed in cases of defamation per se, and if it is assumed that a statement was defamatory per se, the law does not presume any particular amount of damages beyond nominal damages.” (In re Lipsky (2015) 460 S.W.3d 579, 593.)
Section 904 of the Restatement (Second) of Torts provides as follows:
"General damages" are compensatory damages for a harm so frequently resulting from the tort that is the basis of the action that the existence of the damages is normally to be anticipated and hence need not be alleged in order to be proved.

“The proper measure of damages is dependent upon the nature of the cause of action. In common law tort actions for fraudulent misrepresentations, the so-called "out of pocket" rule for measuring general damages has been applied. Under the "out of pocket" rule, the damages are measured by the difference between the price paid (or the value parted with) and the value received.” (Johnson v. Willis (1980) 596 S.W.2d 256, 262; Woo v. Great Southwestern Acceptance Corp. (1978) 565 S.W.2d 290, 297-298.)
“In common law contract actions brought for misrepresentations, which are in the nature of breaches of warranty, Texas courts have applied the so-called "loss of bargain" rule in measuring damages. Under this "loss of bargain" rule, the damages are measured by the difference between the value of the goods as warranted and the value as received.” (Johnson v. Willis, supra; Woo v. Great Southwestern Acceptance Corp., supra.)
“The Supreme Court of Texas has explained that there are three types of damages that may be at issue in defamation proceedings:
(MacFarland v. Le-Vel Brands LLC (2017) No. 05-16-00672-CV, at *23 citing Hancock v. Variyam (2013) 400 S.W.3d 59, 65.)
Nominal damages "are a trivial sum of money awarded to a litigant who has established a cause of action but has not established that he is entitled to compensatory damages." (Id.) Actual or compensatory damages are intended to compensate a plaintiff for the injury he incurred and include general damages, which are non-economic damages such as for loss of reputation or mental anguish, and special damages. (Id.) Both an individual and a corporation may suffer reputation damages that are noneconomic in nature. (See Waste Mgmt. of Tex., Inc. v. Tex. Disposal Sys. Landfill, Inc. (2014) 434 S.W.3d 142, 146.)
“If a statement is defamatory per se, no independent proof of damage to the plaintiff's reputation is required, as the defamation itself gives rise to a presumption of general damages.” (Bentley v. Bunton (2003) 94 S.W.3d 561, 604.)
“Historically in Texas, defamation per se claims allow the jury to presume the existence of general damages without proof of actual injury. (Hancock v. Variyam (2013) 400 S.W.3d 59, 65 citing Bentley v. Bunton (2002) 94 S.W.3d 561, 604; see alsoRestatement (Second) of Torts § 621 cmt. a (1977).) “But the First Amendment requires competent evidence to support an award of actual or compensatory damages when the speech is public or the level of fault is less than actual malice.” (Hancock at 65.) “Thus, the Constitution only allows juries to presume the existence of general damages in defamation per se cases where:

“A defrauded party is entitled to those damages resulting directly and naturally from fraud as general damages.” (Scott v. Sebree (1999) 986 S.W.2d 364, 371 citing El Paso Dev. Co. v. Ravel (1960) 339 S.W.2d 360, 363.) “Although special damages must be shown to be the proximate result of fraud, general damages are allowed and assumed by the statute.” (Id. at 365.)
“The word ‘damages’ has an ordinary meaning that encompasses every loss or diminution occasioned by the fault of another.” (Woodyard v. Hunt 695 S.W.2d (1985) 730, 732 citing Magnolia Pipe Line Co. v. City of Tyler (1961) 348 S.W.2d 537.) “While the common definition may enable a jury to find that some general kind of damage has occurred, ‘damages’ in a fraud case are measured by a particular standard.” (Id.) “The proper measure of damages for fraud is the difference between the price paid and the value received,” (Success Motivation Institute, Inc. v. Lawlis (1973) 503 S.W.2d 864, 867) or “the difference between the value received and the value as represented.” (Wright v. Carpenter (1979) 579 S.W.2d 575, 577 n. 1.)
“[General damages] include general (or non-pecuniary) damages, such as physical and psychological pain and suffering and physical impairment, as well as special (or pecuniary) damages, such as loss of earning capacity and medical costs.” (Cal Dive Offshore Contractors Inc. v. Bryant (2015) 478 S.W.3d 914, 924.) “Because Texas law permits the recovery of the same damages as those recoverable under English law, we conclude the trial court did not abuse its discretion when it submitted [plaintiff's general] damages to the jury using a question adapted from the Texas Pattern Jury Charge. (See Golden Eagle Archery, Inc. v. Jackson (2003) 116 S.W.3d 757, 763 (identifying types of damages recoverable under Texas law in a personal injury action); see also Hatfield v. Solomon (2010) 316 S.W.3d 50, 57 (stating that trial court has broad discretion in submitting charge to the jury so long as charge is legally correct).)
