What Is a Notice of Appearance?
Background
Notices of appearance are required for the purposes of enabling the court and parties in civil cases to communicate all necessary and vital information during the course of the litigation as well as for the exchange and filing of pleadings. (See generally, Mabon Ltd. v. Afri–Carib Enters., Inc.(2012) 369 S.W.3d 809.)
Indeed, Rule 8 of the Texas Rules of Civil Procedure provides that “[a]ll communications ... with respect to a suit shall be sent to the attorney in charge,” and that any change of that designation must be made by written notice to the court and the other parties.” (City of Tyler v. Beck (2006) 196 S.W.3d 784, 787 citing Tex. R. Civ. P. 8.)
“However, nothing in the rule indicates that a motion filed by an attorney other than the designated attorney in charge is void or that other attorneys are not authorized to act on behalf of the party.” (City of Tyler, supra, 196 S.W.3d at 787.)
How to Structure the Notice
The notice itself is generally structured as follows:
- A statement providing the name, address, and telephone number and any other relevant contact information;
- The name of the party represented for all claims and defenses;
- Signature block and Bar Number.

Importantly, under Rule 8, “[o]n the occasion of a party's first appearance through counsel, the attorney whose signature first appears on the initial pleadings for any party shall be the attorney in charge, unless another attorney is specifically designated therein. ” (Tex. R. Civ. P. 8.)
Defendant's Notice of Appearance
“The defendant may, in person, or by attorney, or by his duly authorized agent, enter an appearance in open court. Such appearance shall be noted by the judge upon his docket and entered in the minutes, and shall have the same force and effect as if the citation had been duly issued and served as provided by law.” (Tex. R. Civ. P. 120.)
“Merely being named as a defendant does not make one a party to the lawsuit.” (Mapco, Inc. v. Carter (1991) 817 S.W.2d 686, 687.)
The importance of a Defendant's appearance lies in the fact that “[t]he Due Process Clause of the Fourteenth Amendment requires that once a defendant makes an appearance, that defendant is entitled to notice of the trial setting. (Mabon Ltd. v. Afri–Carib Enters., Inc. (2012) 369 S.W.3d 809, 813 citing e.g., LBL Oil Co., 777 S.W.2d at 390–91.)
Under Tex. R. Civ. P. 121, “[a]n answer shall constitute an appearance of the defendant so as to dispense with the necessity for the issuance or service of citation upon him.” Indeed, notice of appearance by defendants is effectuated with the filing of an answer to the complaint or petition. (See e.g., Highsmith v. Highsmith (2019) 587 S.W.3d 771, 778 citing LBL Oil Co. v. Int'l Power Servs. (1989) Inc. , 777 S.W.2d 390, 390–91 [reversing a default judgment rendered without notice to the defendant, who had made an appearance in the case by filing a motion to dismiss.])
The Court’s Decision
“Unless required by the express language or the context of the particular rule, the term `hearing' does not necessarily contemplate either a personal appearance before the court or an oral presentation to the court.” (Martin v. Martin, Martin Richards, Inc. (1998) 989 S.W.2d 357, 359.)
“[W]hen a party is represented by counsel who has made an appearance, rules 8 and 21a require that all communications be sent to the party's attorney. (Morin v. Boecker (2003) 122 S.W.3d 911, 914 citing Bruneio v. Bruneio (1994) 890 S.W.2d 150, 155 ["[The] rules suggest that . . . notice . . . [be] sent to the attorney in charge if the party is represented, or to the party himself if pro se.”])
