What Is a Motion to Bifurcate?
Background
“Tex.R. Civ. P. 174(b) permits a trial court to order a separate trial on any issue ‘in furtherance of convenience or to avoid prejudice.’” (Tarrant Regional Water Dist. v. Gragg (2004) 151 S.W.3d 546 at 556 [applying abuse of discretion standard of review to bifurcation determination]; see also, City of Justin v. Rimrock Enters., Inc. (2015) 466 S.W.3d 269, 286.)
Bifurcated Trials and Punitive Damages
When the supreme court first announced the scheme for bifurcated trials in cases involving punitive damages, it said:
[I]f presented with a timely motion, [the trial court] should bifurcate the determination of the amount of punitive damages from the remaining issues.... Under this approach, the jury first hears evidence relevant to liability for actual damages, the amount of actual damages, and liability for punitive damages. . ., and then returns findings on these issues. If the jury answers the punitive damage liability question in the plaintiff's favor, the same jury is then presented evidence relevant only to the amount of punitive damages, and determines the proper amount of punitive damages, considering the totality of the evidence presented at both phases of the trial.
(In re Bradle (2002) 83 S.W.3d 923, 926 citing Transportation Ins. Co. v. Moriel (1994) 879 S.W.2d 10, 30.) The Legislature subsequently enacted chapter 41 of the Texas Civil Practices and Remedies Code which essentially codified Moriel, among other things. (Id.)“Moriel expressly, and section 41.009 implicitly, mandates that the same jury that hears the liability phase of a case must also hear the punitive damages phase.” (Id. at 926.)
How to Structure the Motion
Rule 174 of the Texas Rules of Civil Procedure provides that a court “in furtherance of convenience or to avoid prejudice may order a separate trial of:
- any claim,
- cross-claim,
- counterclaim, or
- third-party claim, or
- of any separate issue or of any number of claims, cross-claims, counterclaims, third-party claims, or issues.”
(Tex. R. Civ. P. 174(b); In re B.L.D. (2003) 113 S.W.3d 340, 346 [trial court may order separate trials to avoid prejudice.])
[T]he differences between Rules 41 and 174(b) are that severance divides the lawsuit into two or more independent causes, each of which terminates in a separate, final, and enforceable judgment. (Kansas University Endowment v. King (1961) 350 S.W.2d 11, 19.) The separate trial results in an interlocutory order determining the claims or issues so tried, but there is only one final judgment that is entered after all claims and issues involved in the suit have been tried. (Id.)
Motions For Bifurcation Based on Punitive Damages
The Texas Civil Practice and Remedies Code provides that, on a defendant's motion, the court shall provide for a bifurcated trial. (Tex. Civ. Prac. Rem. Code Ann. § 41.009(a) [Vernon 1997].) “A motion under this section shall be made prior to the voir dire examination of the jury....” (Mackey v. U.P. Enter. (2005) No. 12-99-0355-CV, at *1 citing id.)
In Texas, proportionality is achieved by having punitive damages assessed based on a totality of the evidence from both phases of the bifurcated trial. Southwest Ref. Co. v. Bernal (2000) 22 S.W.3d 425, 433.) A jury assessing the amount of punitive damages must necessarily know of and consider the severity of the wrongdoing and the extent of actual damages. (Id.; see also Alamo Nat'l Bank v. Kraus (1981) 616 S.W.2d 908, 910.)
Under Alamo, “[f]actors to consider in determining whether an award of exemplary damages is reasonable include:
- the nature of the wrong;
- the character of the conduct involved;
- the degree of culpability of the wrongdoer;
- the situation and sensibilities of the parties concerned; and
- the extent to which such conduct offends a public sense of justice and propriety.”
(Alamo Nat'l Bank, id.)
For these reasons, the same jury must, therefore, sit in both phases of the trial. (Id.)
The Court’s Decision
“A severable cause of action may be tried separately under the provisions of Rule 174, but an issue that might properly be the subject of a separate trial is not necessarily severable.” (Kansas Univ. Endowment Ass'n, 350 S.W.2d at 19. The court of appeals reviews a trial court's denial of a motion to order separate trials for abuse of discretion. (See Tarrant Reg'l Water Dist. v. Gragg (2004) 151 S.W.3d 546, 556 (Tex. 2004); In re E.R. (2005) No. 02-04-117-CV, 2005 WL 327263, at *8 [mem. op.])
“An abuse of discretion in denying a motion for separate trials occurs [w]hen all of the facts and circumstances of the case unquestionably require a separate trial to prevent manifest injustice, and there is no fact or circumstance supporting or tending to support a contrary conclusion, and the legal rights of the parties will not be prejudiced thereby. . . .” (In re T.G. (2013) No. 12-12-00435-CV, at *3 citing Womack v. Berry (1956) 291 S.W.2d 677, 683.)
Denial of Motion for Bifurcation
“Although it is often preferable or even necessary to bifurcate the trial of an inverse condemnation case so that takings issues are tried to the bench before damage issues are submitted to the jury, [the court's] statements in neither Wood Oil (State v. Wood Oil Distributing, Inc. (1988) 751 S.W.2d 863, 865) nor Heal (“State v. Heal (1996) 917 S.W.2d 6, 9) support the District's argument that separate trials must be conducted on taking and compensation issues in every case. Accordingly, the trial court did not abuse its discretion in denying the District's bifurcation motion.” (Tarrant Regional Water Dist. v. Gragg (2004) 151 S.W.3d 546, 557.)
Concerning the use of “shall” in chapter 41 of the Texas Civil Practices and Remedies Code, “‘[s]hall’ is an imperative term by ordinary meaning and requires the performance of the act to be performed. It should be treated as a mandatory term, unless it is apparent that the legislature intended otherwise. (Balios v. Tex. Dep't of Pub. Safety (1987) 733 S.W.2d 308, 310.) Texas Government Code section 311.016(2) states that the use of the word "shall" imposes a duty. Tex. Gov't Code Ann. § 311.016(2) [Vernon 2005].) [The court] found no authority indicating that the legislature, in enacting the provision, did not intend "shall" as a mandate. Therefore, [the court] conclude[ed] the trial court erred in granting the untimely filed motion to bifurcate. (Mackey v. U.P. Enter. (2005) No. 12-99-0355-CV, at *1 [explaining, “[i]n apparent response to the Moriel decision, the legislature amended section 41.009 to define ‘timely,’ providing that ‘a motion under this subsection shall be made prior to the voir dire examination of the jury or at a time specified by a pretrial court order. . . .’ (Tex. Civ. Prac. Rem. Code § 41.009(a).) The trial court made no applicable pretrial order in this case, and Appellees did not file their motion until two days after the voir dire of the jury.”)
