Leor filed an Expedited Petition to Approve Compromise of Pending Action on Behalf of Minor on January 21, 2020. On February 4, 2020, the Court issued a detailed minute order regarding Leor Michael’s Expedited Petition and the defects therein. The Court set a hearing on the Expedited Petition for March 9, 2020. On February 6, 2020, Leor filed the instant an Expedited Petition to Approve Compromise of Pending Action on Behalf of Minor.

On November 12, 2019, Petitioner Morsheda Keka (“Petitioner”) filed an Expedited Petition to Approve Compromise of Pending Action (the “first Expedited Petition”) on behalf of minor Plaintiff Ahmed Muaj (“Claimant”). On November 22, 2019, the Court found it could not grant the first Expedited Petition because of several defects. On December 4, 2019, Petitioner filed the instant[1] Expedited Petition to Approve Compromise of Pending Action (the “Second Expedited Petition”).

Accordingly, the Expedited Petition is placed off calendar. Court clerk to give notice.

However, thereafter, within Section 17 of the Expedited Petition, when requested to identify the total amount of [a]ttorneys fees to be paid from the proceeds of settlement, Petitioners counsel of record states $242.92. (Expedited Petition, Section 17c.) Petitioner must correct this discrepancy, and identify consecutively within the Expedited Petition exactly how much in attorneys fees is requested. Third, a copy of the parties retainer agreement is not attached to the petition.

EXPEDITED PETITION TO APPROVE COMPROMISES OF PENDING ACTION ON BEHALF OF MINOR (CRC 7.950.5(c)(1)) TENTATIVE RULING: Amended Expedited Petition of Cecilia Elias to Approve Compromise of Pending Action on Behalf of Minor Plaintiff William Lopez, Jr. is GRANTED. ANALYSIS: On June 4, 2019, minor Plaintiff William Lopez, Jr.

The Petition initially came for hearing on November 19, 2018, at which time the court found that Petitioner failed to mark Item Nos. 11, 13, and 16 and that it could not grant the Expedited Petition at that time. The court continued the hearing to January 24, 2019 to allow Petitioner to file an amended Expedited Petition that cures the above defects. Petitioner filed an amended Expedited Petition on November 28, 2018.

DISCUSSION The Court presently considers Petitioner Angela Esquivels Petition for Expedited Approval of Compromise of Action For Minor, Claimant Joe Esquivel III. Petitioners Petition for Expedited Approval of Compromise of Action For Minor may be referenced below as Expedited Petition.

Expedited Petition for Minor’s Compromise TENTATIVE RULING The Court approves the expedited petition for minor’s compromise with the following corrections and additions: At the court’s invitation, Petitioner was instructed to submit an Expedited Petition for Approval of Minor’s Compromise after the court did not approve the attorney’s fees requested in the prior petition. An expedited petition was submitted on April 16, 2020.

EXPEDITED PETITION TO APPROVE COMPROMISES OF PENDING ACTION ON BEHALF OF MINOR (CRC 7.950.5(c)(1)) TENTATIVE RULING: Expedited Petition of Deniece Reed to Approve Compromise of Pending Action on Behalf of Minor Plaintiff Jaheim Reed is GRANTED.

A petition for court approval of a compromise of a minor must be fully completed. (See CRC 7.950.) This Expedited Petition was twice continued on May 3 and 25, 2018 due to various procedural issues the Court identified in the Expedited Petition.

However, the Court found various issues that precluded the granting of the expedited petition. The Court thus denied the expedited petition without prejudice and indicated Petitioner may resubmit the petition correcting the identified defects.

The expedited petition spells Claimants last name Magdelano, but the first amended complaint spells her last name Magdaleno. Petitioner should correct the spelling in the expedited petition if it is incorrect or amend the complaint if it is incorrect. Petitioner has used an outdated version of the Judicial Council expedited petition form. Petitioner should use the current version of the Judicial Council expedited petition form.

Since the expedited petition filed on June 22, 2020 is properly approved, the Court denies the expedited petition filed on July 15, 2020. The only notable difference between the two petitions is the latter requests a hearing date. Considering the petition may be approved without a hearing during this COVID-era, the Court approves the June 22, 2020 petition and denies the July 15, 2020 petition as moot. In sum, the expedited petition filed on June 22, 2020 is APPROVED.

Petitioner filed the first Expedited Petition to Approve Compromise of Pending Action (the “Petition”) on behalf of Claimant on February 24, 2020. On April 1, 2020, the Court issued an order finding the first Expedited Petition defective and setting the matter for hearing on September 17, 2020. On August 27, 2020, Petitioner filed a second Expedited Petition to Approve Compromise of Pending Action. Court approval is required for all settlements of a minor’s claim. (Prob.

A petition for court approval of a compromise of a minor must be fully completed. (See CRC 7.950.) This Expedited Petition was thrice continued on May 3 and 25, and June 22, 2018 due to various procedural issues the Court identified in the Expedited Petition.

No opposition was filed to the expedited petition. As will be stated below, the Court grants the expedited petition as it is unopposed.

Nature of Proceedings: Petition to Approve Compromise of Disputed Claim Appearance required. (CRC 7.952.) Note: The petition has been set for a hearing and is no longer being treated as an expedited petition. Moreover, this petition does not qualify for treatment as an expedited petition. An expedited petition may be brought for amounts above $50,000 if petitioner shows that defendants are judgment proof outside of their insurance coverage. (CRC 7.950(a)(7).)

On November 22, 2019, the Court found it could not grant the first Expedited Petition because of several defects and set the matter for hearing on February 24, 2020.

On December 14, 2018, Petitioner Hrair Shamoyan (“Petitioner Shamoyan”), as guardian ad litem, filed the instant Expedited Petition to Approve Compromise of Pending Action (the “Expedited Petition”) on behalf of claimant and minor Michael M. Shamoyan (“Claimant Shamoyan”). On the same date, Petitioner Annabelle C.

Conclusion Based on the foregoing, the Expedited Petition to Approve Compromise of Pending Action on Behalf of Minor is DENIED. Court clerk to give notice.

Because of the foregoing defects, the Court cannot grant the Amended Expedited Petition at this time. The hearing on this Amended Expedited Petition is CONTINUED to January 3, 2019 at 8:30 a.m. in Department 94. Petitioner is to file supplemental papers to address the defects raised herein and file them by December 1, 2018. The Court would be inclined to grant the Amended Expedited Petition when the defects identified herein are cured. Petitioner to give notice.

The expedited petition is denied without prejudice, however, for the following reasons: Petitioner filed an expedited petition to approve the compromise, but scheduled a hearing date of 9/01/17. Expedited petitions do not typically have hearing dates. That being said, the Court wishes to have a hearing on the petition in light of the attorneys’ fees issue, below. The Court therefore asks that Counsel re-filed this as a scheduled petition with a hearing date, rather than an expedited petition.

The Court previously reviewed the Expedited Petition and found it incomplete, in violation of Cal. Rules of Court, Rules 7.950, subdivision (a). (Minute Order, 06/01/22.) Specifically, the Expedited Petition does not attach a copy of any medical records regarding minor Plaintiffs treatment for the allegedly serious injuries sustained. (Pet., ¶8.) The Court set the Expedited Petition for hearing to allow Petitioner to file supplemental papers. (Minute Order, 06/01/22.)

Petitioner, therefore, cannot bring the instant Expedited Petition under CCP § 372 and must, instead, satisfy Prob. Code § 3500. Petitioner, however, fails to submit a declaration satisfying the requirements of Prob. Code § 3500. The Court notes, though, that the Expedited Petition is complete in all other respects. Accordingly, the Court is inclined to GRANT the Expedited Petition on the CONDITION that Petitioner files a declaration satisfying Prob.

However, the Court again cannot locate proof of service of the petition and related papers on Defendant. The expedited petition is therefore again denied without prejudice.

TENTATIVE: On April 12, 2021, the Court denied the expedited petition after identifying various defects. Petitioner was ordered to file an amended petition, amended proposed order, and supplemental documents correcting the identified defects. On April 28, 2021, Petitioner filed an amended expedited petition and proposed orders.

On August 14, 2019, Susan Portillo (“Petitioner”) filed an Expedited Petition to Approve Compromise of Pending Action (the “first Expedited Petition”) on behalf of minor Plaintiff Juan Portillo (“Claimant”). On November 27, 2019, the Court found it could not grant the Expedited Petition because Petitioner had yet to be appointed Claimant’s guardian ad litem. The Court set the Expedited Petition for hearing on February 20, 2020.

Petitioner filed the instant Expedited Petition to Approve Compromise of Pending Action (the “Petition”) on behalf of Claimant on October 16, 2019. On December 17, 2019, the Court issued an order regarding the Expedited Petition, finding it incomplete in several respects. (Minute Order, 12/17/19.) As a result, the Court set the Expedited Petition for hearing on March 9, 2020. (Ibid.) Notice of the order was served on both parties on the same date. (Certificate of Mailing, 12/17/19.)

On September 27, 2022, Petitioner Ahamad filed an Expedited Petition to Approve Compromise of a Disputed Claim on behalf of minor Claimant Kaylee Dickerson. (Expedited Petition, ¶¶ 11, 12.) Claimants gross amount of proceeds of settlement is $1,000.00. (Expedited Petition, ¶ 17.) The claimants attorneys fees and costs total $400.59, including $60.30 in medical expenses, $250.00 in attorneys fees and $90.29 in litigation costs. (Expedited Petition, ¶ 17; Attachment Nos. 12, 13(a), 13c(2)14(a), 14(b).) The balance of the proceeds of the settlement available for claimant equal $599.41. (Expedited Petition, ¶ 17(f).)

As a result, the Court ordered Petitioner to file supplemental papers to cure the defects of the three expedited petitions. (10/3/18 Minute Order.) On May 13 and 23, 2019, Petitioner filed thee Amended Expedited Petitions to Approve Compromises of Pending Action (collectively, the “Amended Expedited Petitions”) on behalf of Claimants. The one Amended Petition filed on May 13 is on behalf of Claimant David, and the two Amended Petitions filed on May 23 are on behalf of Claimants Manuel and Vania.

GOURAN, ROBERT Renewed Expedited Petition to Approve Compromise of Minor’s Claim for Katelyn Hopping On May 4, 2022, the court issued an intended ruling that identified petitioner’s failure to complete paragraph 20 of the expedited petition, which does not identify the disposition of the settlement proceeds for the minor. Petitioner has not remedied this deficiency and the petition remains defective.

Here, the Petition clearly sets forth that payments to all parties exceeds $50,000.00, as a payment of $250,000.00 has been offered by Defendants to Petitioner. (Petition, ¶ 12(b)(3).) As such, the expedited petition is defective under Cal. Rules of Court, Rule 7.950.5(a)(8). Petitioner should not have filed an expedited petition given the amount of settlement as to all parties. II.

A petition for minors compromise must be filed instead of an expedited petition for the following reasons: The total settlement amount is more than $50,000; all Defendants have not appeared and therefore are not participating in the compromise or alternatively, the court has not determined the settlement to be in good faith .

He is specially appearing in the matter to inform the Court that Defendant has received the Complaint, Summons, and Petition, and does not intend to oppose the Expedited Petition. ( Ibid. ) Thus, the Court found that the Expedited Petition was properly served on Defendant. (7-18-23 Minute Order.)

On September 27, 2022, Petitioner Ahamad filed an Expedited Petition to Approve Compromise of a Disputed Claim on behalf of minor Claimant Kaylee Dickerson. Gonzalez On April 24, 2018, Petitioner Mariyam Gasparyan (“Petitioner”) filed an Expedited Petition to Approve Compromise of Pending Action (the “Expedited Petition”) on behalf of minor Claimant Jasmine Kaprelian (“Claimant”). Petitioner has not been appointed by the Court as Claimant’s guardian ad litem. No complaint has been filed in this action. Court approval is required for all settlements of a minor’s claim. (Prob. Code §§ 3500, 3600, et seq.; CCP § 372.)

PARTY : None PETITION FOR EXPEDITED APPROVAL OF MINORS COMPROMISE OF A DISPUTED CLAIM (CCP § 372, CRC, rule 7.950.5) TENTATIVE RULING : The hearing on the Petition for Expedited Approval of Minors Compromise, filed on behalf of Minor Noe Alexander Duenas, is GRANTED.

Having reviewed the Amended Petition, the Court finds it is complete and provides for a reasonable settlement to minor Plaintiff based the injuries sustained and future prognosis. Proposed orders to deposit funds and granting the Expedited Petition were filed on February 24, 2021. Therefore, Petitioner Nicole Knox’s Amended Expedited Petition to Approve Minor’s Compromise of Disputed Claim on behalf of minor Plaintiff Vivien Knox is GRANTED. Moving party to give notice.

Based on the expedited petition, it also was not clear that there are no unresolved disputes concerning liens to be satisfied from the proceeds of the compromise as is required for expedited approval. See CRC 7.950.5(a)(4). Additionally, Attachment 18a in the expedited petition did not correspond to number 18.a. in the petition and the Attorney Fee Agreement should have been part of Attachment 14a. There was also no Attachment 19b(2) as required.

As such, counsel must file a minors compromise, and not an expedited minors compromise. Second, Defendant LAUSD was not served with the petition. Moving party is ordered to give notice.

On July 5, 2022, the Court denied without prejudice Petitioner Magdalena Blas Martinezs expedited petition for minors compromise. On November 10, 2022, Petitioner Magdalena Blas Martinez filed a renewed expedited petition. II.

As with Lucine’s expedited petition, the expedited petition as to Natalie is denied without prejudice for the same reasons, namely: Petitioner seeks to have Natalie’s settlement paid to a parent without any restrictions. The Court will not approve distribution of the settlement in this manner in connection with an expedited petition.

The Court considers the Expedited Petition filed in May instead of the ones filed in January. Petitioner was appointed as Claimants’ guardian ad litem on June 21, 2018. Court approval is required for all settlements of a minor’s claim. (Prob. Code §§ 3500, 3600, et seq.; CCP § 372.) A petition for court approval of a compromise of a minor must be fully completed. (See CRC 7.950.) Having reviewed the Expedited Petitions, the Court finds them to be complete.

Petitioner addressed the issues in an amended expedited petition filed on August 1, 2023. However, Petitioner did not file an amended proposed order granting the petition, and, as such, the Court cannot approve the petition. Accordingly, the Expedited Petition for Approval of Minors Compromise is CONTINUED, and Counsel is ordered to file a new proposed order. Moving party¿is ordered¿to give notice.¿

Petitioner filed the instant Petition for Expedited Approval of Compromise of Claim or Action or Disposition of Proceeds of Judgment for Minor (the Petition) on September 22, 2021. On October 14, the Court noted several issues with the Petition. (10/14/21 Minute Order.)

(Expedited Petition, ¶¶ 11, 12.) Claimants gross amount of proceeds of settlement is $1,000.00. (Expedited Petition, ¶ 17.) The claimants attorneys fees and costs total $340.29, including $250.00 in attorneys fees and $90.29 in litigation costs. (Expedited Petition, ¶ 17; Attachment Nos. 12, 14(a), 14(b).) The balance of the proceeds of the settlement available for claimant equal $659.71. (Expedited Petition, ¶ 17(f).)

Case Number: 21STCV41338 Hearing Date: July 20, 2023 Dept: 29 TENTATIVE The Court has reviewed the Petitioner Karen Fletchers Expedited Petition to Approve Minors (Austin Fletcher, age 5) Compromise without a hearing pursuant to Cal Rules of Court 7.950.5. The Court notes the following issues with the petition: First, the Petitioners and Claimants names are the same under Items 1 and 2 of the Expedited Petition.

The petition states that, of the $225,000, $5,542.17 is for medical expenses, $56,250.00 is for attorneys’ fees, and $13,207.83 is for expenses, leaving a balance of $150,000. (Petition ¶ 18.) Here, Petitioner has filed an Expedited Petition to Approve Minor’s Compromise.

Since then, Plaintiff has been tasked with perfecting its petition to approve minor's compromise. At the last hearing, on January 31, 2024, the Court reviewed and continued the Expedited Petition to Approve Minors Compromise so that Plaintiff could correct a list of deficiencies that the Court outlined. No paperwork has since been filed. Accordingly, the Expedited Petition to Approve Minor's Compromise is denied.

On March 6, 2023, Torres (Petitioner) filed the instant Expedited Petition to Approve Minors Compromise of Disputed Claim (Petition). No opposition has been filed. The Court issued an order on March 23, 2023 identifying several errors in the Petition. (03/23/23 Minute Order.)

Per CRC Rule 7.950.5(c)(1), a hearing must be held on the Expedited Petition because the Court is not granting it. The Court hereby schedules a hearing on the Expedited Petition for January 26, 2022 at 8:30 a.m. in Department SS-30 . Petitioner is ordered to file an amended petition, amended proposed order approving the compromise, a proposed order to deposit money into blocked account, and supplemental documents correcting the above-identified issues.

Based on the expedited petition, it also was not clear that there are no unresolved disputes concerning liens to be satisfied from the proceeds of the compromise as is required for expedited approval. See CRC 7.950.5(a)(4). Additionally, Attachment 18a in the expedited petition did not correspond to number 18.a. in the petition and the Attorney Fee Agreement should have been part of Attachment 14a. There was also no Attachment 19b(2) as required.

By minute order issued on November 22, 2021, the Court expressed is concerns regarding the instant Expedited Petition and set the matter for hearing on December 17, 2021. (Minute Order, 11/22/21.) The Court ordered Petitioner to file an amended Petition at least nine court days prior to the hearing date. ( Ibid .) To date, however, no amended Petition has been filed.

.: BC713222 Hearing Date: NO HEARING RULING RE: Expedited Petition to Approve Compromise of Pending Action of a Minor, Deon Spriggs, Age 16 The Court finds the Expedited Petition to Approve Compromise of Pending Action of a Minor, Deon Spriggs, Age 16 (“Claimant”) is must be denied for two reasons. First, it is unclear whether there are outstanding medical liens. Paragraph 14a(1) states Claimant has $2,484.04 in total medical expenses.

To date, Petitioner has not filed an amended petition correcting the deficiencies in the original Expedited Petition as ordered. Therefore, Petitioner Nicole Knox’s Expedited Petition to Approve Minor’s Compromise of Disputed Claim on behalf of minor Plaintiff Vivien Knox is DENIED. Court clerk to give notice.

In the Court’s order, there was no mention of an expedited petition. Thus, the court had ordered otherwise, and therefore, Plaintiff does not meet all the requirements to file an expedited petition under rule 7.950.5(a). In any event, even if the Court were to consider the expedited petition to be properly filed, the Court finds that there is one problem with the petition.

On March 15, 2023, the Court noted several deficiencies in the Expedited Petition and set a hearing for April 18, 2023. (3-15-23 Minute Order.) On April 18, 2023, the Court found that Petitioner did not file supplemental papers correcting the deficiencies and denied the Petition without prejudice. (4-18-23 Minute Order.) On May 3, 2023, Petitioner filed the instant Expedited Petition to Approve Minors Compromise of Disputed Claim (Petition).

Per CRC 7.950.5, a hearing needs not be held for this Expedited Petition. The Expedited Petition is GRANTED. The Court to sign and enter the Orders (MC-351 and MC-355) lodged by Petitioner. Court clerk to give notice.

On January 20, 2018, Petitioner Nelson Okeke (“Petitioner”) filed an Expedited Petitioner to Approve Minor’s Compromise (“Expedited Petition”) on behalf of Claimant McKenzie Okeke (“Claimant”). Court approval is required for all settlements of a minor’s claim. (Prob. Code §§ 3500, 3600, et seq.; CCP § 372.) A petition for court approval of a compromise of a minor must be fully completed. In an expedited petition and proposed order filed on April 28, 2022, on Anthony Coyotls behalf the petitioner is again named as Diane K. Mireles.

Expedited Petition to Approve Compromise of Disputed Claim of a Minor filed on 8/20/18 on behalf of Diana Vega The Court previously reviewed the Expedited Petition to Approve Compromise of Disputed Claim of a Minor filed on 8/20/18 on behalf of Diana Vega, Age 17. The court declined to approve the petition and set this hearing date to allow Petitioner to correct the defects. An amended petition has not been filed. The defects remain. There is no signed order appointing a Guardian ad Litem for Diana Vega.

Petitioner’s Amended Expedited Petition to Approve Compromise of Minor’s Claim, filed September 24, 2018, is denied without prejudice. The amended petition fails to set forth the name, branch and address of the depository in California in which the balance of proceeds of settlement will be deposited. (See Amended Petition at ¶ 20(b)(2).) Petitioner is required to fully complete the expedited petition pursuant to California Rules of Court rule 7.950.5(a) in order for the petition to be granted.

Discussion On October 8, 2020, Petitioner Gabriela Nava Hernandez (“Petitioner”) filed the instant action by way of Expedited Petition to Approve Compromise of Pending Action (“Expedited Petition”) on behalf of minor Claimant (“minor Claimant”) Eden Santander . On February 16, 2021, the Court granted Petitioner’s application to be appointed minor Claimant’s Guardian Ad Litem.

The Court set the Expedited Petition for hearing on June 7, 2021 and ordered Petitioner to file an amended petition correcting the defects. ( Ibid .) Notice of the Court’s order was served on Petitioner on the same date, but no amended petition has been filed as instructed. Therefore, Petitioner Gabriela Nava Hernandez’s Expedited Petition to Approve Minor’s Compromise of Disputed Claim on behalf of minor Plaintiff Eden Santander is DENIED.

.: BC721937 Hearing Date: NO HEARING [TENTATIVE] RULING RE: Expedited Petition to Approve Compromise of Pending Action of a Minor, Alexia Rosales, Age 17 The Court finds the Expedited Petition to Approve Compromise of Pending Action of a Minor, Alexia Rosales (“Claimant”), Age 17, filed on June 22, 2020, is properly approved.

The court will not review an amended petition until a guardian ad litem is appointed. Petitioner must submit an amended petition and proposed orders with all the corrections and required attachments. This will be eighth expedited petition. If the petition is again denied, the court will require Petitioner to file a petition with a noticed hearing date.

On February 13, 2019, Petitioner filed the instant Expedited Petition to Approve Compromises of Pending Action (the “Expedited Petition”) on behalf of Claimant. In its previous Minute Order, the Court instructed Petitioner to file an attorney’s affidavit to justify the requested amount of $2,500 in attorney’s fees for the $7,500 in settlement money. (6/3/19 Minute Order.) On June 11, 2019, Petitioner filed such an attorney’s affidavit.
