An action must “be brought to trial within five years after the action is commenced against the defendant.” Code Civ. Proc., § 583.310. If the action is not brought to trial within five years, the action “shall be dismissed by the court on its own motion or on the motion of the defendant, after notice to the parties.” Code Civ. Proc. §583.360(a). Dismissal of the action is “mandatory and... not subject to extension, excuse, or exception except as expressly provided by statute.” Code Civ. Proc., § 583.360(b); Munoz v. City of Tracy (2015) 238 Cal.App.4th 354, 358. The burden is on plaintiff to see the action is brought within the 5-year period since defendant’s presence in the action is involuntary. Martin v. K&K Properties, Inc. (1987) 188 Cal.App.3d 1559, 1567; Cannon v. City of Novato (1985) 167 Cal.App.3d 216, 222.
“A trial within the meaning of § 583 is the determination of an issue of law or fact which brings the action to the stage where final disposition can be made. A case is brought to trial if it has been assigned to a department for trial, it is called for trial, the attorneys have answered that they are ready for trial, and proceedings begin, even if the proceeding is a motion for judgment on the pleadings.” Bruns v. E-Commerce Exchange, Inc. (2011) 51 Cal.4th 717, 723; Lemaire, Faunce & Katznelson v. Cox (1985) 171 Cal.App.3d 297, 301. Or, in a nonjury trial, an action is brought to trial “when the first witness is sworn.” Hartman v. Santamarina (1982) 30 Cal.3d 762, 765.
The purpose of the five-year restriction on bringing an action to trial is “to prevent avoidable delay for too long a period.” Tamburina v. Combined Insurance Company of America (2007) 147 Cal.App.4th 323, 328; Baccus v. Super. Ct. (1989) 207 Cal.App.3d 1526, 1532. “Under the press of this statutory requirement, anyone pursuing an action in the California courts has an affirmative obligation to do what is necessary to move the action forward to trial in timely fashion.” Tanguilig v. Neiman Marcus Group, Inc. (2018) 22 Cal.App.5th 313, 322.
The parties may agree by written stipulation to extend the time within which the action must be brought to trial. Code Civ. Proc., § 583.330(a). To serve as an extension of the five-year period, “the stipulation must be written and extend in express terms the time of trial to a date beyond the five-year period or expressly waive the right to a dismissal. Stipulations that merely extend the time for trial within the five-year period, absent a showing that the parties intended otherwise, will not extend the five-year period.” Miller & Lux, Inc. v. Super. Ct. [(1923)] 192 Cal. 333, 338; J.C. Penney Co. v. Super. Ct. (1959) 52 Cal.2d 666, 669, 343 P.2d 919; Sanchez v. City of Los Angeles (2003) 109 Cal.App.4th 1262, 1269. “The stipulation need not be filed but, if it is not filed, the stipulation shall be brought to the attention of the court if relevant to a motion for dismissal.” Code Civ. Proc., § 583.330(a). A stipulation may also be made “[b]y oral agreement made in open court, if entered in the minutes of the court or a transcript is made.” Code Civ. Proc., § 583.330(b).
Other exceptions to the five-year rule are limited to where the jurisdiction of the court was suspended, prosecution of the action was stayed, or it is shown that bringing the action to trial was “impossible, impracticable, or futile.” Code Civ. Proc. §583.340; Tamburina v. Combined Ins. Co. of American (2009) 147 Cal.App.4th 323, 336; Bruns v. E–Commerce Exchange, Inc. (2011) 51 Cal.4th 717, 726. The question of impossibility, impracticability, or futility is best resolved by the trial court, which “is in the most advantageous position to evaluate these diverse factual matters in the first instance.” Brunzell Constr. Co. v. Wagner (1970) 2 Cal.3d at p. 555, 86 Cal.Rptr. 297, 468 P.2d 553. “‘[I]mpracticability and futility’ involve a determination of ‘excessive and unreasonable difficulty or expense,’ in light of all the circumstances of the particular case.” Brunzell Constr. Co. v. Wagner (1970) 2 Cal.3d 545, 554, 86 Cal.Rptr. 297, 468 P.2d 553.
The exceptions must be interpreted liberally, consistent with the policy favoring trial on the merits. Kaye v. Mount La Jolla Homeowners Ass’n (1988) 204 Cal.App.3d 1476, 1482. “In determining whether the exception applies, the trial court must consider ‘all the circumstances of a particular case, including the conduct of the parties and the nature of the proceedings.’” Moss v. Stockdale, Peckham & Werner (1996) 47 Cal.App.4th at p. 502, 54 Cal.Rptr.2d 805. “The critical factor in applying the exceptions to a given factual situation is whether the plaintiff exercises reasonable diligence in prosecuting his or her case.” Moran v. Super. Ct. (1983) 35 Cal.3d 229, 237. “The ‘reasonable diligence’ standard is an appropriate guideline for evaluating whether it was impossible, impracticable, or futile for the plaintiff to comply with [the statutory five-year constraint] due to causes beyond his or her control.” Wilshire Bundy Corp. v. Auerbach (1991) 228 Cal.App.3d 1280, 1287–1288, 279 Cal.Rptr. 488. Furthermore, in determining whether it was impracticable or futile to bring the action to trial, the trial court should consider “the potential impact on that case of appellate proceedings in another action without regard to whether the two actions shared common parties.” Dowling v. Farmers Ins. Exchange (2012) 208 Cal.App.4th 685, 697.
The trial court has discretion to determine whether that exception applies, and its decision will be upheld unless the plaintiff has proved that the trial court abused its discretion. Lauriton v. Carnation Co. (1989) 215 Cal.App.3d 161, 164, 263 Cal.Rptr. 476; Bruns v. E-Commerce Exchange, Inc. (2011) 51 Cal.4th 717, 731.

Plaintiff shouldn’t have to choose between a trial without Mr. Pham or two trials, especially since the recent delay in going to trial was caused by his lack of activity in this case. Finally, the Court notes that it does not believe that plaintiff forfeited her right to seek relief here by asking for an accounting. 5. The Court therefore GRANTS the motion to extend time for trial, but only to October 16, 2019, given that the delay caused by Mr. Pham’s “radio silence” was about 3-4 months.

In selecting an appropriate discovery sanction, the trial court exercises broad discretion, which will be reversed only for a manifest abuse of discretion. (Ibid.) Sanctions require two prerequisites: a failure to comply with discovery and a willful failure to do so. (Ibid.) III. Application At the outset, the Court notes that the motion to extend time and the motion for terminating sanctions are discussed together.

Pro se litigants are subjected& to the same restrictive rules of procedure as does any trial lawyer. ( Monastero v. Los Angeles Transit Co . (1955) 131 Cal.App.3d 156, 160.) A doctrine generally requiring or permitting exceptional treatment of parties who represent themselves would lead to a quagmire in the trial courts, and would be unfair to the other parties to litigation. Defendant’s motion references Code of Civil Procedure section 2024.050, relating to an extension of the discovery cut-off date, and the deadline to have motions concerning discovery heard in relation to the trial date.
