Any party to an arbitration in which an award has been made may petition the court to confirm, correct, or vacate the award. (Code Civ. Proc. § 1285.) Section 1285 authorizes a petition to confirm only by a "party to the arbitration in which the award has been made." California trial courts continue to recite this framework verbatim: on a petition to confirm, correct, or vacate, the court has exactly four options — confirm the award as made, correct and confirm it as corrected, vacate it, or dismiss the proceeding. (Code Civ. Proc. § 1286; UniFirst Corporation v. In and Out Tire LLC (L.A. Super. Ct., Dept. 55, Dec. 2, 2025) [tentative ruling], citing Hall v. Superior Court (1993) 18 Cal.App.4th 427, 433; One Ring Networks, Inc. v. Sagoo (L.A. Super. Ct., Dept. 26, Aug. 10, 2023) [tentative ruling], citing Cooper v. Lavely & Singer Professional Corp. (2014) 230 Cal.App.4th 1, 10.)
Judicial review is deliberately narrow. As the court explained in Castano v. Brown (L.A. Super. Ct., Aug. 14, 2020) (Hon. Michael P. Linfield) [tentative ruling], "[a]rbitration awards are subject to very limited judicial review, and the merits of the controversy are not reviewable on a petition to confirm, vacate, or correct."
The petition must:
(Code Civ. Proc. § 1285.4.) Courts confirm when these contents are supplied. In UniFirst, the petition was granted because the petitioner attached the arbitration agreement (Attachment 4(b)), named the arbitrator, and attached the award (Attachment 8(c)) — the court cited Loeb v. Record (2008) 162 Cal.App.4th 431, 450 for the required contents. The same box-checking analysis drove confirmation in One Ring Networks (§ 1285.4 satisfied by attaching the agreement, naming the arbitrator, and setting forth the award of $22,096.38) and in LG H&H Co., Ltd. v. Kim (L.A. Super. Ct., Dept. 78, Apr. 8, 2024) [tentative ruling].
The petition must be filed and served no more than four years after the award is served on the petitioner (Code Civ. Proc. § 1288), and — a point courts now emphasize alongside the outer limit — not less than 10 days after service of the award. (Code Civ. Proc. § 1288.4.) The neutral arbitrator must serve a signed copy of the award personally, by registered/certified mail, or as provided in the agreement. (Code Civ. Proc. § 1283.6.) UniFirst applied this squarely: award served November 15, 2024, petition served August 22, 2025 — "[a]ccordingly, the petition is timely."
Service of the petition, the notice of hearing, and any other supporting papers must be accomplished in the manner provided in the arbitration agreement. (Code Civ. Proc. § 1290.4(a).) If the agreement is silent and service is within California, service must be made as for a summons. (Code Civ. Proc. § 1290.4(b)(1).)
This is the single most common reason petitions fail on Trellis, and recent rulings show courts enforcing it strictly:
Practical takeaway from the current rulings: serve the petition itself plus the notice of hearing and all supporting papers, in the agreement's manner or, if silent, as a summons, and file a proof of service that specifically identifies the petition among the documents served.
The allegations of a duly served and filed petition are deemed admitted unless a response is duly served and filed. (Code Civ. Proc. §§ 1290, 1290.6.) The response deadlines are strict: a response seeking to vacate or correct must be served and filed within 10 days of service of the petition to confirm, and in no event later than 100 days after service of a signed copy of the award. (Code Civ. Proc. §§ 1290.6, 1288.2.)
One Ring Networks is the current illustration of how these deadlines decide contested petitions. The respondent's competing petition to correct or vacate was filed both more than 100 days after the award was served (award served Dec. 13, 2022; deadline Mar. 23, 2023; served Apr. 24, 2023) and outside the 10-day window after service of the petition to confirm. Because the respondent offered no explanation, the court held it "cannot consider" the untimely challenge, citing Law Finance Group, LLC v. Key (2023) 14 Cal.5th 932, 945 — and confirmed the award. A response does not have to defeat confirmation: in Tat Chan v. HSBC Securities (USA) Inc. (L.A. Super. Ct., Dept. 55, Mar. 3, 2026) [tentative ruling], the respondent filed a response but the petition was still granted.
Even a facially compliant petition can be denied where a statutory vacatur ground exists. Section 1286.2 is written in the disjunctive: the court "shall vacate the award if the court determines any of the following," including that (1) the award was procured by corruption, fraud, or other undue means, or (4) the arbitrators exceeded their powers.
Castano v. Brown denied confirmation on exactly these grounds. The court found the award was procured by "undue means" because the arbitrator gave notice by letter rather than by "e-mail, certified or registered mail" as the agreement required, and that the arbitrator "exceeded his powers" by conducting the arbitration in Virginia instead of Los Angeles and failing to state whether California law was applied (§ 1286.2(a)(1), (a)(4)). The court also rejected the petitioner's argument that due-process misconduct under (a)(3) was the only path to vacatur — the statute is disjunctive.
If the award is confirmed, judgment is entered in conformity with it, and once entered the judgment "may be enforced like any other judgment of the court in which it is entered." (Code Civ. Proc. § 1287.4.) Courts routinely require the petitioner to submit a proposed judgment that tracks the award — in JPG Law, APC v. Long (Santa Barbara Super. Ct., May 12, 2023) (Hon. Donna Geck) [tentative ruling], the court granted the petition but directed the petitioner to submit an amended proposed order reflecting "the precise award that was made by the arbitrator."
On confirmation, the court awards costs as provided in Code of Civil Procedure section 1021 et seq. (Code Civ. Proc. § 1293.2.) One Ring Networks confirms the mechanics: attorney's fees and costs are recoverable on a petition to confirm (§ 1293.2; MBNA America Bank, N.A. v. Gorman (2006) 147 Cal.App.4th Supp. 1, 7), by noticed motion (fees) and memorandum of costs (costs), with any interest set out as a calculation in the proposed judgment.
| Requirement | Statute | What courts do |
|---|---|---|
| Petition contents (agreement, arbitrators, award) | § 1285.4 | Confirm when all three attached — UniFirst, One Ring, LG H&H |
| Timeliness (≤ 4 yrs, ≥ 10 days) | §§ 1288, 1288.4, 1283.6 | Confirm if within window — UniFirst |
| Serve the petition itself + notice + papers | § 1290.4 | Deny without prejudice / continue for defective service — HaHa Smart, Skelton, Creditors Adjustment Bureau |
| Response deadlines (10 days / 100 days) | §§ 1290.6, 1288.2 | Untimely vacatur challenge disregarded; award confirmed — One Ring |
| Vacatur grounds (disjunctive) | § 1286.2 | Deny confirmation for undue means / exceeding powers — Castano |
| Judgment + costs/fees | §§ 1287.4, 1293.2 | Enter conforming judgment; fees by motion, costs by memo — JPG Law, One Ring |
