Understanding Sexual Harassment in California

What Is Sexual Harassment?

Sexual harassment, under both California's Fair Employment and Housing Act (FEHA) and federal Title VII of the Civil Rights Act of 1964, constitutes unlawful discrimination based on sex. It includes quid pro quo harassment, where employment benefits are conditioned on submission to unwelcome sexual advances, and hostile work environment harassment, where pervasive or severe conduct creates an abusive workplace. To be actionable, the conduct must be unwelcome, based on sex, and sufficiently severe or pervasive to alter employment conditions. Employers may be liable if they knew or should have known about the harassment and failed to take corrective action.

“In Hughes v. Pair, 46 Cal.4th at pages 1042-1043, the California Supreme Court recently restated the framework of sexual harassment law in California: Like federal law, California law prohibits sexual harassment in the workplace.” (See Haberman v. Cengage Learning, Inc., 180 Cal.App.4th 365 (Cal. Ct. App. 2009); Hughes v. Pair, 46 Cal.4th 1035 (Cal. 2009).)

“Originally enacted in 1980, Government Code section 12940 is part of the FEHA. [Citation.] It defines an unlawful employment practice' as an employer's refusal to hire, employ, or select for a training program leading to employment, any person because of that person's race, religious creed, color, national origin, ancestry, physical disability, mental disability, medical condition, marital status, sex, age, or sexual orientation.” (See id.)

“Since 1985, the FEHA has prohibited sexual harassment of an employee. With respect to sexual harassment in the workplace [citation], the prohibited conduct ranges from expressly or impliedly conditioning employment benefits on submission to, or tolerance of, unwelcome sexual advances to the creation of a work environment that is hostile or abusive to employees because of their sex.” (See id.)

“Thus, similar to the federal law's Title VII [title VII of the Civil Rights Act of 1964], California's FEHA `recognize[s] two theories of liability for sexual harassment claims quid pro quo harassment, where a term of employment is conditioned upon submission to unwelcome sexual advances . . . [and] hostile work environment, where the harassment is sufficiently pervasive so as to alter the conditions of employment and create an abusive work environment.” (See id.)

Title VII Sexual Harassment

“Enacted in 1964, Title VII (42 U.S.C. § 2000e et seq.) defines as an unlawful employment practice discrimination by an employer based on an applicant's or employee's race, color, religion, sex, or national origin.’” (See Hughes v. Pair, 46 Cal.4th 1035, 1041 (Cal. 2009); 42 U.S.C. § 2000e-2(a)(1).)

“The prohibition covers employment decisions and conduct affecting compensation, terms, conditions, or privileges of employment. An employer violates Title VII by refusing to hire or promote someone solely because of that person's gender. Such conduct is sex discrimination.” (See id; Automobile Workers v. Johnson Controls, Inc. (1991) 499 U.S. 187, 197 [113 L.Ed.2d 158, 111 S.Ct. 1196].)

“Title VII treats sexual harassment as another form of sex discrimination. Just as an employee who is subjected to the loss of some economic or tangible job benefit as the result of sex discrimination can sue under Title so can an employee who is subjected to [u]nwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature.” (See Hughes v. Pair, 46 Cal.4th 1035, 1041 (Cal. 2009); Meritor Savings Bank v. Vinson (1986) 477 U.S. 57, 64 [91 L.Ed.2d 49, 106 S.Ct. 2399;].)

Hostile Work Environment and Quid Pro Quo Sexual Harassment

“Federal law recognizes two forms of sexual harassment. One is a demand for sexual favors in return for a job benefit; this is known as quid pro quo harassment.” (See Hughes v. Pair, 46 Cal.4th 1035, 1042 (Cal. 2009); Burlington Industries, Inc. v. Ellerth (1998) 524 U.S. 742, 753 [141 L.Ed.2d 633, 118 S.Ct. 2257].)

“The other is sexually harassing conduct that, although not resulting in the loss of or denial of any job benefit, is so ‘severe or pervasive’ as to create a hostile work environment. The terms ‘quid pro quo’ and ‘hostile work environment’ are not in Title VII's text; they first turned up in academic literature, found their way into federal appellate decisions, and after their mention by the high court in, acquired their own [legal] significance.” (See id.)

“Under Title VII, sexual harassment is considered severe or pervasive only when it alter[s] the conditions of [the victim's] employment and create[s] an abusive working environment. Taken into account must be the surrounding circumstances, such as the frequency of the discriminatory conduct; its severity; whether it is physically threatening or humiliating, or a mere offensive utterance; and whether it unreasonably interferes with an employee's work performance. Thus, simple teasing, offhand comments, and isolated incidents (unless extremely serious) will not amount to discriminatory changes in employment conditions.” (See id at 271; Faragher v. Boca Raton (1998) 524 U.S. 775, 787-788 [141 L.Ed.2d 662, 118 S.Ct. 2275].)

Elements of Hostile Work Environment and Quid Pro Quo Claims

“The elements of a cause of action for hostile work environment harassment are:

  1. plaintiff belongs to a protected group;
  2. plaintiff was subject to unwelcome sexual harassment;
  3. the harassment complained of was based on sex;
  4. the harassment complained of was sufficiently pervasive so as to alter the conditions of employment and create an abusive working environment; and
  5. respondeat superior.”

(See Blanchard v. Pier 1 Imports (U.S.), Inc., No. A126243, at *1 (Cal. Ct. App. Oct. 14, 2010); Fisher v. San Pedro Peninsula Hospital (1989) 214 Cal.App.3d 590, 608.)

“A party alleging quid pro quo sexual harassment must show that a tangible employment action resulted from a refusal to submit to a supervisor's sexual demands.” (See Lohman v. City of Mountain View, No. H046681, at *15 (Cal. Ct. App. Sep. 7, 2022); Hughes v. Pair, 46 Cal.4th 1035, 1049 (Cal. 2009).)

Establishing a Hostile Work Environment Claim

“In construing California's FEHA, this court has held that the hostile work environment form of sexual harassment is actionable only when the harassing behavior is pervasive or severe.” (See Hughes v. Pair, 46 Cal.4th 1035, 1043 (Cal. 2009); Miller v. Department of Corrections, 36 Cal.4th 446, 462 (Cal. 2005).)

“This limitation mirrors the federal courts' interpretation of Title VII. To prevail on a hostile work environment claim under California's FEHA, an employee must show that the harassing conduct was severe enough or sufficiently pervasive to alter the conditions of employment and create a work environment that qualifies as hostile or abusive to employees because of their sex. There is no recovery for harassment that is occasional, isolated, sporadic, or trivial.” (See id; Aguilar v. Avis Rent A Car System, Inc. (1999) 21 Cal.4th 121, 130 [87 Cal.Rptr.2d 132, 980 P.2d 846].)

“Courts that have construed federal and California employment discrimination laws have held that an employee seeking to prove sexual harassment based on no more than a few isolated incidents of harassing conduct must show that the conduct was ‘severe in the extreme.’” (See Hughes v. Pair, 46 Cal.4th 1035, 1043 (Cal. 2009); Herberg v. California Institute of the Arts, 101 Cal.App.4th 142, 151 (Cal. Ct. App. 2002); Candelore v. Clark County Sanitation Dist. (9th Cir. 1992) 975 F.2d 588, 590 [isolated incidents of sexual horseplay over number of years held insufficient]; Saxton v. American Tel. Tel. Co. (7th Cir. 1993) 10 F.3d 526, 528, 534-535 [summary judgment for defendant upheld where defendant rubbed and kissed plaintiff on one occasion and groped her on another].)

“A single harassing incident involving ‘physical violence or the threat thereof’ may qualify as being severe in the extreme.” (See id; Lyle v. Warner Brothers Television Productions, 38 Cal.4th 264, 284 (Cal. 2006).)

“Under California's FEHA, as under the federal law's Title VII, the existence of a hostile work environment depends upon the totality of the circumstances. We said in Lyle, supra, 38 Cal.4th at page 284, that [t]o be actionable, `a sexually objectionable environment must be both objectively and subjectively offensive. . . .' Therefore, a plaintiff who subjectively perceives the workplace as hostile or abusive will not prevail . . . if a reasonable person . . ., considering all the circumstances, would not share the same perception.” (See id.)

Burden of Proof and Standard of Review for Sexual Harassment Claims

“In a harassment/hostile work environment case, the focus is on the workplace environment as a whole. Accordingly, a hostile environment may exist even if some of the hostility is directed at other workers.” (See Bryant v. Sara Lee Corporation, No. A120084, at *1 (Cal. Ct. App. Feb. 17, 2009).)

“[A] plaintiff may establish a violation of Title VII by proving that discrimination based on sex has created a hostile or abusive work environment.” (See Sepulveda v. United Parcel Serv., Inc., No. H038738, at *18 (Cal. Ct. App. July 11, 2016); Meritor Sav. Bank, FSBv. Vinson (1986) 477 U.S. 57, 65 (Vinson).)

“In short, [i]n order to survive summary judgment on a claim of hostile work environment harassment, a plaintiff must produce evidence that the workplace is permeated with discriminatory intimidation, ridicule, and insult, that is sufficiently severe or pervasive to alter the conditions of the victim’s employment.” (See Trotman v. Southern California Edison Company, No. B215903, at *1 (Cal. Ct. App. June 7, 2010); Cruz v. Coach Stores, Inc., 202 F.3d 560, 570 (2d Cir. 2000); Yanowitz v. L'Oreal USA Inc., 36 Cal.4th 1028, 1052-1053 (Cal. 2005).)

“Thus, a vital component of a hostile work environment harassment claim under federal law is proof that the employer had knowledge of the existence of the hostile environment. In most cases, this is established by a showing that complaints about the harassment were lodged with the employer. The employer may defend by pointing to prompt remedial action reasonably calculated to end the harassment." (See Wellpoint Health Networks, Inc. v. Superior Court, 59 Cal.App.4th 110, 126 (Cal. Ct. App. 1997); Katz v. Dole, supra,709 F.2d at p. 256.)

“[I]n employment discrimination cases, courts place the burden of proof on the employee to demonstrate an employer's discriminatory intent. If the employee establishes a prima facie case, the employer must offer a legitimate reason for his actions. . . However, the burden of persuasion never shifts to the employer; it remains at all times with the employee. . .If the plaintiff establishes a prima facie case, the defendant bears only a burden of going forward with additional evidence of legitimate nondiscriminatory reasons.” (See Sargent Fletcher, Inc. v. Able Corp., 110 Cal.App.4th 1658, 1672 (Cal. Ct. App. 2003); Sada v. Robert F. Kennedy Medical Center (1997) 56 Cal.App.4th 138, 149-150.)

“We review the trial court's grant of summary judgment on [plaintiff’s] causes of action for sexual harassment and retaliation de novo. Thus, we independently determine whether an issue of material fact exists and whether the moving party is entitled to summary judgment as a matter of law. We independently review the parties' papers supporting and opposing the motion, using the same method of analysis as the trial court. Essentially, we assume the role of the trial court and apply the same rules and standards.” (See Lohman v. City of Mountain View, No. H046681, at *14-15 (Cal. Ct. App. Sep. 7, 2022); Hutton v. Fidelity National Title Co. (2013) 213 Cal.App.4th 486, 493-494.)

“We consider all of the evidence set forth in the moving and opposing papers, except the evidence to which objections were made and sustained, but we liberally construe the evidence in support of the party opposing summary judgment, resolving doubts concerning the evidence in favor of that party.” (See id; Civ. Proc., § 437c, subd. (c); Hughes v. Pair (2009) 46 Cal.4th 1035, 1039 (Hughes).)

“We are not bound by the trial court's stated reasons or rationales. As we review the ruling, not the rationale, we are not concerned with the findings made by the trial court in support of its ruling.” (See id; (Castillo v. Glenair, Inc. (2018) 23 Cal.App.5th 262, 284-285 (Castillo), disapproved on another ground in Grande v. Eisenhower Medical Center (2022) 13 Cal.5th 313, 332.)

Notable Decisions Discussing Sexual Harassment in the Workplace

“With respect to sexual harassment in the workplace the prohibited conduct ranges from expressly or impliedly conditioning employment benefits on submission to, or tolerance of, unwelcome sexual advances to the creation of a work environment that is "hostile or abusive to employees because of their sex." (See Hughes v. Pair, 46 Cal.4th 1035, 1042-43 (Cal. 2009); Gov. Code, § 12940, subd. (j)(4)(C)), Miller v. Department of Corrections (2005) 36 Cal.4th 446, 462 [ 30 Cal.Rptr.3d 797, 115 P.3d 77] ( Miller).)

“Thus, similar to the federal law's Title VII, California's FEHA recognize[s] two theories of liability for sexual harassment claims . . . `. . . quid pro quo harassment, where a term of employment is conditioned upon submission to unwelcome sexual advances . . . [and] hostile work environment, where the harassment is sufficiently pervasive so as to alter the conditions of employment and create an abusive work environment.” (See id; Herberg v. California Institute of the Arts (2002) 101 Cal.App.4th 142, 149 [ 124 Cal.Rptr.2d 1], citations omitted (Herberg).)

“Although there are some differences in the wording of the federal law's Title VII and California's FEHA, these laws share the same antidiscriminatory goals and serve the same public policies.” (See id; Lyle v. Warner Brothers Television Productions, 38 Cal.4th 264, 278 (Cal. 2006).)

“A hostile work environment sexual harassment claim requires a plaintiff employee to show:

  1. he or she was subjected to unwelcome sexual advances, conduct or comments;
  2. the harassment was based on sex; and
  3. the harassment was sufficiently severe or pervasive to alter the conditions of employment and create an abusive working environment.”

(See Lewis v. City of Benicia (2014) 224 Cal.App.4th 1519, 1524.)

“The Fair Employment and Housing Act (“FEHA”) makes it unlawful for an employer to “harass an employee because of the employee’s ‘sex, gender, gender identity, gender expression,... [or] sexual orientation.’” Taylor v. Nabors Drilling USA, LP (2014) 222 Cal.App.4th 1228, 1235-36 (quoting Govt. Code, § 12940(j)(1)).
