California Code of Regulations|§ 11166 - Reasonable Accommodation

                                                

It is a discriminatory practice where a recipient of State support fails to make reasonable accommodation to the religious belief of an ultimate beneficiary where such accommodation can be made without undue hardship on the recipient or other ultimate beneficiaries.

Section 11166(c) provides that a mandated reporter who fails to report known or reasonably suspected child abuse is guilty of a misdemeanor. Stecks v. Young (1995) 38 Cal.App.4th 365, 374, holds, “section 11166 subdivision (a) creates an affirmative obligation upon designated professionals to report known and suspected child abuse and to do so within specified time frames. The failure to report can subject mandated reporters to both criminal prosecution (§ 11172 subd. (e)) and civil liability.”

Defendants are mandated reporters under Penal Code section 11166. The claim thus arises out of their protected activity within the meaning of CCP section 425.16. The plaintiff fails to present sufficient evidence to show a reasonable probability of success. Indeed, plaintiff’s opposition fails entirely to address and distinguish the applicable immunities that prevent him from meeting his burden on the second prong.

Section 11166 expressly states that “[t]he reporting duties under this section are individual.” Pen. Code §11166, subd. (i)(1). While Section 11166 includes separate reporting obligations for particular public agencies, including county probation and welfare departments (subd. (j)(1)) and law enforcement agencies (subd.
