The court having read and considered Plaintiff's Motion for Judgment on the Pleadings filed September 29, 2023 and the court having reviewed the pleadings filed herein rules as follows. Plaintiff seeks judgment pursuant to CCP 438 asserting that Defendants' General Denial filed August 24, 2023 fails to state facts sufficient to constitute a defense. The court has reviewed the General Denial and finds that Defendants have stated facts sufficient to constitute a defense as to the amount of arrears in lease payments sought by Plaintiff. The General Denial indicates the vehicle was turned over to Plaintiff's assignor prior to the termination of the lease. Plaintiff's Complaint does not establish the term over which Plaintiff claims these arrears in lease payments occurred nor what steps in mitigation were undertaken by Plaintiff's assignor.
