Limited Conservatorship in California

The petition was not for limited conservatorship, and the minute order grants the petition for Appointment of Probate Conservator and appoints petitioner as "conservator." The order and letters, however, are for "Limited" Conservatorship. The order does not have box #13 checked in as required. The Letters state conservator Alvin Glenn Sykes is appointed conservator not limited conservator at #1. Box #3.g is not checked when it should be as there is an attachment #3.g. to the Letters.

In this case, after a full assessment and letter of support by the regional center on 2/7/12, this court placed regional center client Allyson Schreiner under limited conservatorship on 2/28/12. That limited conservatorship was properly managed until the limited conservator withdrew earlier this year for good cause. The court, as reprimanded by the Department of Developmental Services for appointing it as successor limited conservator on 3/26/13, vacates that ruling.

(Probate Code §1860.5(f)) The court shall order the termination of the limited conservatorship unless the court finds, on the record and by clear and convincing evidence, that the limited conservatee still meets the criteria for appointment of a limited conservator under Section 1801 and a limited conservatorship remains the least restrictive alternative needed for the limited conservatee's protection.

Today, it would likely be a limited conservatorship. The conservator's biennial status report, timely filed on June 21, 2017, indicates that due to conservator's health and age, conservator can no longer serve. The conservator can no longer visit the conservatee because of distance. The court has reviewed the report, and it is complete. No appearance is required.

In addition to this notice, the court investigator has spoken directly to the limited conservator about his duty to timely file status report. The letters of limited conservatorship is suspended. The Public Guardian is appointed temporary limited conservator of the person of William Levy. The court sets an order to show cause re removal of Howard Levy as limited conservator for William Levy on 11/18/14, 9:00 a.m., J6.

09/2022 The Court intends to grant both the Petition for Removal of Conservator and Petition for Appointment of Successor Limited Conservatorship.

The limited conservatee, according to the recent investigation report, has one brother and two sisters supportive of the limited conservatorship. The remaining limited co-conservator will likely soon need to transfer the fiduciary reins to a successor or successors, who will hopefully be better at reporting. The conservator was directed to make an appointment with the regional center for purposes of a PC § 1827.5 statutory assessment. The regional center was asked to prepare that assessment for consideration at further hearing this date. Both conservator and conservatee were requested to be present at this hearing.
