Per the 6/4/13 tentative ruling:
"Limited conservatorship was created 8/2/05. Judge Lane waived accountings on limited co-conservators' representation "only $3200 assets now and the only future expected assets will be social security" (8/2/05 minute order). Unbeknowst to the probate court, limited conservatee received $381,000 in personal injury settlement proceeds on 9/25/07 in CIV 234035. A SNT was created to receive the funds by the civil court and, though a court-created trust, the SNT contained none of the statutory requirements of CRC 7.903, particularly as it relates to bonding, accounting, investment restrictions, and payment of attorney fees.
On 1/15/13, on suspicion of possible embezzlement from the SNT account, this court suspended the limited co-conservators/trustee and appointed professional fiduciary Angelique Friend as provisional limited conservator/trustee.
