Upon review of the file, the Court has concerns re: capacity declaration filed 11/06/18. Completed by Lani J. Ashley, Ph.D. a CA licensed psychologist acting within her licensure, Dr. Ashley states that she completed the capacity declaration based on a "records review – not face to face." Dr. Ashley states the proposed conservatee is able to attend the hearing. Dr. Ashley concludes the proposed conservatee lacks the capacity to give informed consent to any form of medical treatment. The Court does not believe that a records review is sufficient for the capacity declaration. Discuss.
