What Are the Laws on Requesting Court Reporter Services?
Background
A request for a court reporter’s services is important for purposes of appellate procedure. In order to preserve an issue for appeal, the complaining party must show that they properly objected to a specific issue and that the trial court either ruled on the objection or refused to rule on the objection and the complaining party objected to the refusal to rule. (Tex. R. App. P. 33.1(a).) Proof that the motion was presented and proof of an objection to a refusal to rule is derived primarily from the reporter's record. (Cruz v. Schell, Beene & Vaughn, L.L.P., No. 05-01-00565-CV.) Therefore, failure to record a hearing, or failure to provide a court recorder after a request has been made, can directly impede a party's ability to establish preservation of error on appeal. (In re Larkin, 516 S.W.3d 583, 585; Emesowum v. Morgan, No. 14-13-00397-CV.)
The Supreme Court of Texas has the authority to adopt rules for the duties and fees of official court reporters in all civil proceedings. (Tex. Gov't Code Ann. § 52.046(c).)
How to Structure the Motion
Upon request, a court reporter must
- attend all sessions of the court;
- record oral testimony, including objections, remarks to objections, court rulings, and exceptions to the rulings;
- record closing arguments, including objections to the arguments, remarks on the objections, and exceptions to the rulings;
- preserve the records for future reference for three years from the date on which they were taken; and
- furnish a transcript of the report.
A request for a court reporter must be timely. (Tex. R. App. P. 33.1). To be timely, a request for a court reporter, or an objection to the failure to provide a court reporter, must be made as soon as it becomes apparent so that the trial court has the opportunity to rule on the matter and correct the error before proceeding. (Kohler v. M & M Truck Conversions, NO. 2-08-332-CV.)
Once a court reporter is requested, the trial court must provide one for trial. (Gov't § 52.046(a)(1)-3); Tex. R. App. P. 13.1(a); In re Larkin, 516 S.W.3d 583, 585.) The trial court has no discretion to deny the request. (Id.) Additionally, if a defendant fails to request a court reporter, or object to the failure to provide a court reporter, then the defendant waives the error. (Tex. R. App. P. 13.1(a); Barry v. Jackson, No. 03-11-00549-CV.)
On appeal, an appellant may be entitled to a new trial if:
- if the appellant has requested a reporter's record;
- if, without the appellant's fault, a significant portion of the court reporter's notes and records has been lost or destroyed;
- if the lost, destroyed, or inaudible portion of the reporter's record is necessary to the appeal's resolution; and
- if the lost, destroyed or inaudible portion of the reporter's record cannot be replaced by agreement of the parties or with a copy determined by the trial court to accurately duplicate the original exhibit.
