487.020.  

Except as provided in paragraph (2) of subdivision (a) of Section 3439.07 of the Civil Code, the following property is exempt from attachment:

(a) All property exempt from enforcement of a money judgment.

(b) Property which is necessary for the support of a defendant who is a natural person or the family of such defendant supported in whole or in part by the defendant.

(c) “Earnings” as defined by Section 706.011.

(d) All property not subject to attachment pursuant to Section 487.010.

To the extent Defendant Kato can provide evidence that any of the deposit accounts to be attached contain earnings, such amounts are exempt pursuant to CCP section 487.020(c). While Defendant Kato provides a declaration stating he provides support to his two minor children and ex-wife, he did not state any amount "necessary for the support ... [his] family..." (Code Civ. Proc., § 487.020.) This Court cannot guess as to the amount to be exempt.

Section 487.020(b) provides that property necessary for the support of a defendant who is a natural person is exempt from attachment. Section 704.080 provides an automatic exemption for certain amounts of directly deposited social security benefits (in this case, up to $3,500). (Code Civ.
