116.221.

In addition to the jurisdiction conferred by Section 116.220, the small claims court has jurisdiction in an action brought by a natural person, if the amount of the demand does not exceed twelve thousand five hundred dollars ($12,500), except as otherwise prohibited by subdivision (c) of Section 116.220 or subdivision (a) of Section 116.231.

(Amended by Stats. 2023, Ch. 861, Sec. 6. (SB 71) Effective January 1, 2024.)

Section 116.221 expands that jurisdiction to $7,500 in actions brought by a natural person. CCP § 85 defines limited jurisdiction cases as those in which the amount in controversy ?does not exceed? $25,000. There is no minimum value for a limited jurisdiction case. Certainly, under CCP § 87(a), a limited civil case may be brought in the small claims division if the case is within the jurisdiction of the small claims division. However, the section does not require it to be brought there.

Regarding the jurisdictional argument, Defendants point to Code of Civil Procedure section 116.223, which states in relevant part: Notwithstanding paragraph (1) of subdivision (a) Section 116.220, Section 116.221, or any other law, the small claims court has jurisdiction in any action for recovery of COVID-19 rental debt, as defined in Section 1179.02, and any defenses thereto, regardless of the amount demanded. Flanagan argues that the higher jurisdictional limit of Code of Civil Procedure section 116.221 applies instead. Section 116.221 now provides: “In addition to the jurisdiction conferred by Section 116.220, the small claims court has jurisdiction in an action brought by a natural person, if the amount of the demand does not exceed ten thousand dollars ($10,000) ….”
