MOTION FOR LEAVE
The motion is granted. Defendant shall file the proposed cross-complaint no later than April 27, 2018.
CCP 428.10(b) provides that a party may file a cross-complaint setting forth any cause of action against
a person alleged to liable thereon, whether or not such person is already a party to the action, if the
cause of action arises out of the same transaction or occurrence as the cause brought against him. The
proposed cross-complaint arises out of the same construction project which is the subject of the
complaint. Resolving all claims arising from this accident in a single action is in the interest of justice.
CCP 428.50(c).
If the tentative ruling is uncontested, it shall become the order of the Court, pursuant to Rule
3.1308(a)(1), adopted by Local Rule 3.10, effective immediately, and no formal order pursuant to Rule
3.1312 or any other notice is required as the tentative ruling affords sufficient notice to the parties.
