Admit that Defendant is not alleging that GOLDEN GATE CHIROPRACTIC CENTER, INC committed fraud in this case. 5. Admit that Defendant has no evidence that GOLDEN GATE CHIROPRACTIC CENTER, INC committed fraud in this case. 6. Admit that Plaintiff has standing to pursue this matter. 7. Admit that benefits are not exhausted. 11. Admit that Plaintiff submitted a valid pre-suit demand letter to Defendant in compliance with Fla. Stat. Sec. 627.736(10). 12. Admit the Policy was in full force and effect at the time of and for the subject accident. 13. Admit Defendant was timely furnished with notice of the covered loss with regard to the portions of the Plaintiff’s PIP claim which are the subject of dispute herein. 14. Admit the Plaintiff’s bills were timely submitted to Defendant. 15. Admit that Defendant did not submit a request for additional information to Plaintiff pursuant to Fla. Stat. §627.736(6)(b). 16. Admit that Defendant received an Assignment of Benefits from Plaintiff prior to the filing of this lawsuit.
