I make this declaration based upon my own 24 knowledge. This declaration is made in support of DPB Investment's Post-Trial Brief. The injunctive relief case, which was to be tried in November 2022, differed significantly 27 from this declaratory relief action. DBP had anticipated calling as many as sixteen wimesses for 28 the November trial, including a Gary Black, an expert on parking, who would have opined about Line Offices of Jolrn L. Frrsgerntit I DECLARATION OF JOHN L. FITZGERALD IN SUPPORT OF DBP INVESTMENT'S POST-TRIAL BRIEF the parking usage at King Center; and Ken Mischel, an expert on bowling centers, who would have testified about the operations of bowling centers and the impact time-restricted parking would have on Classic Bowling Center. DBP was also prepared to call percipient witnesses, including employees of Classic Bowling Center, to testify about the effect King's threatened parking restrictions would have on the bowling center, and about the patrons who would be impacted by parking restrictions. A copy of DBP's witness list for the November 2022 trial is attached as Exhibit A. DBP also expected to offer exhibits related to parking at King Plaza at the November 2022 trial, including the results of parking studies and analyses performed by Mr. Black, and 10 photographs depicting the use of parking spaces by vendors of Manilla Market, King's tenant.
