“Pretrial discovery is intended to establish a procedure which results in an informed resolution of a controversy and is thus designed to eliminate surprise.” (See Frolik v. Schuebel, Appeal No. 2016AP674, at *6 (Wis. Ct. App. Aug. 1, 2017).)
“The Washington discovery rules provide for liberal discovery, not limited to matters that will be admissible at trial; the rules only require that the information sought to be discovered is not privileged, is ‘relevant’ and appears ‘reasonably calculated’ to lead to the discovery of admissible evidence.” (See State ex Rel. Mitsubishi v. Milwaukee County (2000) 233 Wis. 2d 1, 16.)
“In general, a party is entitled to discovery of all nonprivileged information relevant to the subject matter involved in the pending action.” (See Security Bank v. Willett, No. 2010AP2750, at *5 (Wis. Ct. App. Oct. 18, 2011).)
“The right to discovery only extends to material relevant to the subject matter involved in the pending action.” (See State ex Rel. Rilla v. Dodge County Cir. Ct. (1977) 76 Wis. 2d 429, 435.)
“The party seeking to discover information has only the burden to prove that it appears reasonably calculated to lead to the discovery of admissible evidence.” (Franzen v. Children's Hospital (1992) 169 Wis. 2d 366, 389 n.41.)
“We review the denial of a motion to compel discovery for an erroneous exercise of discretion.” (See Security Bank v. Willett, No. 2010AP2750, at *3 (Wis. Ct. App. Oct. 18, 2011).)
“Under that standard, we will sustain discretionary acts if we find the circuit court examined the relevant facts, applied a proper standard of law, and using a demonstrative rational process, reached a conclusion that a reasonable judge could reach.” (See Security Bank v. Willett, No. 2010AP2750, at *3 (Wis. Ct. App. Oct. 18, 2011).)
It is well settled that “anything that is relevant to the subject matter involved in the pending action is fair game even though what is sought to be discovered would not itself be admissible at trial if discovery appears reasonably calculated to lead to the discovery of admissible evidence.” (SeeCentury Shop. Ctr. v. Malone Hyde, No. 94-2922, at *1 (Wis. Ct. App. Aug. 1, 1995).)
It is also well settled that “the object of the rule requiring the disclosure of the names of witnesses before trial is to enable the parties to discover the truth and to eliminate surprise, and the policy of discovering all of the truth would be furthered by permitting the witness to testify after the court has postponed his testimony until the element of surprise has been eliminated.” (See Fredrickson v. Louisville Ladder Co. (1971) 52 Wis. 2d 776, 784.)
