 Section Fourteen Hundred and Twenty-eight. An obligation arises either from:
One—The contract of the parties; or,
Two—The operation of law. An obligation arising from operation of law may be enforced in the manner provided by law, or by civil action or proceeding.
The case did not examine the provision of section 1428(b), or the interaction between section 1428(b) and Rules 3.725(a). It appears that there is no binding case law interpreting section 1428(b)’s requirement regarding the filing of a case management statement. In Waterman Convalescent Hospital, Inc. v. State Department of Health Services (2002) 101 Cal.App.4th 1433, 1438-1439, the same district of the court of appeals analyzed the 90-day statute of limitations set forth in section 1428(b).

Thus, at the time section 1428 was amended in 2005, the legislature understood that the court would hold a case management conference regardless of whether the action was pending in a court of limited jurisdiction. There is no basis to conclude from the language of section 1428(b) or its legislative history that the case management statement requirement would be relaxed because the Judicial Council passed an emergency measure after enactment of section 1428(b).

Section 1428(b) provides for its own trigger with respect to case management statements. Section 1428(b) does not link the filing of the case management statement with a case management conference but, rather, connects it to the filing of an answer. Applying the triggering event from Rule 3.725(a) would render the triggering event from section 1428(b) meaningless.
