This matter is on calendar for further proceedings on an Amended Petition for Letters of Administration.
The Court notes that the Petition previously filed a Petition for Probate of a Will, and then a Petition for
Probate of a lost will. Those Petitions stated that the will was self-proving. It is not. Without ever giving
notice to all individuals named in the will, the Petitioner now advises that the decedent died without a
will, and seeks letters of administration. No explanation has been provided as to why Petitioner is no
longer seeking to probate the will. The Petition appears to have several defects. The original Petition
stated that Luis Delgado survived the decedent, and that there were no issue of a predeceased child. This
current Petition now states that Luis is deceased and that the decedent was survived by issue of a
predeceased child. It appears that Luis did not pre-decease the decedent. If he is now deceased, then the
appropriate heir would be the personal representative of Luis’s estate. That person is not identified. The
date of Luis’s death will need to be provided to determine who are the appropriate heirs. Petitioner again
fails to include himself in item 8. As there was a will with a distribution different from intestate
succession, the Court will require the Petitioner to include in item 8 all individuals named in the will and
provide them with notice that the Petitioner is seeking letters of administration and is no longer seeking
to probate the will that names them. Bond waivers have been submitted but they are defective. No bond
waiver was required by the Petitioner since he is not an intestate heir. The remaining waivers state the
intestate heir waives the bond if they are appointed as personal representative, but do not waive bond as
to the Petitioner. Proof of publication has been filed. The above issues were raised by the Court at the
prior hearing on May 20, 2024, and the matter continued to today for the filing of a Second Amended
Petition. No Second Amended Petition has been filed. The above defects remain, and the Court has
contradictory information about the existence of the will and heirs. An appearance is necessary on
today’s calendar to address the above discrepancies. A failure to appear will result in the denial of
the Petition and the closure of the file.

Tentative Ruling on Case Management Conference: This coordinated proceeding is on calendar for a Case
Management Conference. The Court has reviewed the Case Management Conference Statements filed by Plaintiff
Smith and Defendant Sierra Pacific Industries.
STAY. The McDonald matter remains stayed pending appeal.
CLASS NOTICE. The Court appreciates the efforts made by SPI in identifying employees placed at SPI by
staffing agencies and is in agreement with SPI’s suggestions regarding the employees at SPI placed by Sonora
Employment Agency. The Court invites Plaintiff McDonald to discuss the proposals made by SPI.
MOTIONS. There are currently no motions pending in the Smith matter. Pending in McDonald are SPI’s
Motion for Extension of Time to Comply with Court Order Due to Impossibility that was filed on August 31,
2023 and SPI’s Motion for Protective Order Regarding Preservation and Production of Video Camera Footage
that was filed on September 1, 2023. Both motions are stayed.
TRIAL DATES. McDonald is not presently set for trial. The Court notes that Plaintiffs in Smith filed their Third
Amended Complaint on February 28, 2024. SPI filed an Answer on April 2, 2024. As the matter is now at issue,
the parties should be ready to discuss a timeline for a Motion for Class Certification.
FURTHER CASE MANAGEMENT CONFERENCE DATE. The Court intends to set a further Case
Management Conference and will discuss available dates with counsel.
