[TENTATIVE] order RE: OVERRULING DEMURRER TO SECOND AMENDED COMPLAINT

Defendant Los Angeles County Metropolitan Transportation Authority’s Demurrer to the third cause of action is OVERRULED. Defendant Los Angeles County Metropolitan Transportation Authority is ordered to file an answer within ten days of this order.

I. Background Facts

On February 13, 2017, plaintiff Mynor David Jimenez (“Plaintiff”) filed a complaint against defendants Los Angeles County Metropolitan Transportation Authority (“Metro”), Doe Bus Driver and Does 1 through 100 (collectively “Defendants”). On April 27, 2017, Plaintiff filed a First Amended Complaint (“FAC”). On June 27, 2017, the court sustained Metro’s demurrer to the FAC with leave to amend.
