“The purpose of a preliminary injunction is to preserve the status quo pending a decision on the merits of a cause. A preliminary injunction is an extreme remedy that a court should employ only in situations where an emergency exists and serious harm would result if the injunction is not issued.” (Mohanty v. St. John Heart Clinic, S.C (2006) 225 Ill. 2d 52, 84 citing Callis, Papa, Jackstadt Halloran, P.C. v. Norfolk Western Ry. Co. (2001) 195 Ill. 2d 356, 365.)
“[A] party seeking a preliminary injunction must establish that:
(Mohanty, 225 Ill. 2d at 62; Callis, 195 Ill. 2d at 365-66.)
“The decision to grant or deny a preliminary injunction rests within the sound discretion of the circuit court, whose decision will not be disturbed on review absent an abuse of discretion.” (Callis, supra, 195 Ill. 2d at 366; Mohanty v. St. John Heart Clinic, S.C, 225 Ill. 2d 52, 84-85.)
“[I]n order to be entitled to a preliminary injunction, the circuit court must conclude that the balance of the hardships to the parties supports the injunctive relief requested.” (Scheffel Fin. Servs., Inc. v. Heil (2014) 16 N.E.3d 385, 392 citing Delta Medical Systems v. Mid–America Medical Systems, Inc. (2002) 331 Ill.App.3d 777, 789.)
“For purposes of entitlement to a preliminary injunction, the loss of customers and sales and the threat of continuation of such losses to a legitimate business interest are sufficient to show that the business will suffer irreparable injury, with no adequate remedy at law, unless protected by the court.” (Hoover v. Crippen (1987) 151 Ill. App. 3d 864, 867 citing Eagle Books, Inc. v. Jones (1985) 130 Ill. App.3d 407.)
