[PROPOSED] ORDER SUBSTITUTING REAL PARTY IN INTEREST
1 TO ALL PARTIES AND THEIR ATTORNEYS OF RECORD:
2 The motion of Plaintiff Nemat Maleksalehi (hereinafter “Malek”) for an order substituting
3 real party in interest Shahram Tabatabai (“Tabatabai”) as Plaintiff came on for hearing before this
4 Court on April 4, 2022, Honorable Timothy Volkmann presiding. Prior to this hearing, Malek,
5 Tabatabai and Defendant Jeanne Turner Tabatabai (“Turner”) filed with this Court a “Stipulation
6 to Substitute Shahram Tabatabai for Plaintiff Maleksalehi” (the “Stipulation”, a true and correct
7 copy of which is attached hereto as Attachment A) wherein Turner withdrew her Opposition to
8 the pending motion, conditioned on certain agreements between counsel for addressing the
9 substitution and assignment of Plaintiff’s claims in the remainder of the action. The Court, having
10 read and considered the stipulation and arguments of the parties, and finding good cause to support
11 the motion, orders as follows:
12 IT IS ORDERED that Plaintiffs’ motion for an order substituting real party in interest
13 Shahram Tabatabai as Plaintiff in substitution of Malek herein be, and it hereby is, GRANTED.
14 IT IS FURTHER ORDERED that the caption in this case shall be amended to name
15 “Shahram Tabatabai, an individual, as assignee of the claims of Nemat Maleksalehi” as the
16 Plaintiff.
17 IT IS FURTHER ORDERED that the terms and conditions set forth in the Stipulation
18 shall be, and hereby are, incorporated into and made a part of this Order.
