20 On December 6, 2017, in Department 21 of the above-entitled Court, a hearing was held
21 on Plaintiff's ex parte application for abatement of the current action pending the determination
22 of Stanislaus Superior Court Case No: 2009158 (the “2014 Litigation”). As a result of the
23 hearing, the Court ordered the following:
24 1) All demurrers currently pending in the present litigation are continued to February
25 28, 2018 at 8:30am in Dept. 21 of the Stanislaus Superior Court.

2) Plaintiff's deadline to file an opposition to the pending demurrers shall be calculated
in accordance with California Code of Civil Procedure and shall run from the new
hearing date of February 28, 2018.

3 Defendants’ deadline to file a reply to the pending demurrers shall be calculated in
accordance with California Code of Civil Procedure and shall run from the new
hearing date of February 28, 2018.
4) If Plaintiff choses to file a motion for abatement, it shall be filed on regular time in
accordance with the California Code of Civil Procedure with the hearing date of
February 28, 2018 at 8:30am in Dept. 21 of the Stanislaus Superior Court
10 In February of 2018, the parties stipulated to continue the hearings to May 15, 2018. The
11 hearings were continued to August 16, 2018. The hearings were continued to October 31, 2018.
12 The hearings were continued to January 9, 2019. The hearings were continued to April 3, 2019.
13 The hearings were continued again to July 2, 2019. The hearings were continued again to
14 October 8, 2019. The hearings were continued again to December 10, 2019. There are still issues
15 between the parties which require the current motions to be continued. As a result, it is hereby
16 stipulated, by and between the parties through their respective counsel, as follows:
17 1) All demurrers currently pending in the present litigation are continued to February
18 20, 2020 at 8:30am in Dept. 21 of the Stanislaus Superior Court.
19 2 ) Plaintiff's deadline to file an opposition to the pending demurrers shall be calculated
20 in accordance with California Code of Civil Procedure and shall run from the new
21 hearing date of February 20, 2020.
22 3) Defendants’ deadline to file a reply to the pending demurrers shall be calculated in
23 accordance with California Code of Civil Procedure and shall run from the new
24 hearing date of February 20, 2020.
