TO THE HONORABLE COURT:
Plaintiffs Kiki Chess (“Chess”) and Vivian Ly (“Ly”) (collectively, “Plaintiffs”), by and
through their counsel of record, respectfully request that this Court grant permission to file an
opening memorandum to Plaintiffs’ Motion for Class Certification in the above-captioned matter
in excess of the page limits specified in California Rules of Court, Rule 3.1113(d).
Plaintiff attempted to file this application through e-filing on February 11, 2021 but was
informed on February 16, 2021 that the filing was tejected with instructions for Plaintiff to submit
a hard copy with the Clerk’s Office by mail or Dropbox in addition to a check for signing fee.
Plaintiff will re-file the instant application today and send a hard copy by mail to the Clerk’s
10 Office with the signing fee included.
11 The opening memorandum to be filed by Plaintiff on February 16,.2021 is oversized,
12 around thirty (30) pages. This application establishes the need to file an opening memorandum in
13 excess of the page limits as specified in C.R.C. 3.1113(d)...
14 1 This is a putative class action case involving eleven separate causes of action and
15 two putative classes each made up of several distinct subclasses. As Plaintiff bears the burden of
16 justifying that each class is appropriate for class treatment as to each cause of action, Plaintiff's
17 opening memorandum necessarily must incorporate significant factual detail, legal authority, and
18 legal analysis to meet this burden and prevail on the motion.
19 2. The Introduction, Procedural History, and Statement of Facts sections of the
20 opening memorandum comprises of just over three pages despite the significant history, facts of
21 the case, and number of parties involved, and are necessary to help the reader understand the
22 policies, practices, and procedures at issue in this case and the current status of these proceedings,
23 as significant procedural hurdles have been addressed.
24 3 Plaintiffs have also included a section briefly detailing each of the claims that they
25 seek to certify. This section consists of nine separate subheadings concisely covering
26 approximately eight pages.
27 4 Regarding the “Legal Argument” section comprising the majority of the pages of
28 this opening memorandum (approximately 17) Plaintiff will establish six substantive issues,

including: (1) the appropriateness of class certification; (2) ascertainability and numerosity; (3)
that common questions of law and fact predominate; (4) typicality of Plaintiffs’ claims; (5)
fairness and adequacy of the Plaintiffs and Class Counsel; and (6) superiority of a class action.
Plaintiff also must address each of the eleven (11) causes of action in the “common questions of
law and fact” section.
5 The number of pages devoted to each issue is not excessive; in addition, if the
issues addressed in paragraph 4, above, are not properly discussed and analyzed, I run the risk of
failing to exhaust and/orprocedurally failing to preserve Plaintiffs’ rights on appeal, if an appeal is
even necessary.
10 6. As Plaintiffs’ counsel, I have a duty to raise all viable issues before this Court.
ll For these reasons, on behalf of Plaintiffs, I respectfully request that this Court permit and
12 consider Plaintiffs’ opening memorandum in excess of the page limits specified in C.R.C.
