STILES, SBN 280816 Remy Moose Manley, LLP 555 Capitol Mall, Suite 800 Sacramento, CA 95814 Telephone: (916) 443-2745 Email: jmoose@rmmenvirolaw.com Email: cstiles@rmmenvirolaw.com Attorneys for Respondent and Defendant California Department of Water Resources 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1 Stipulation And [Proposed] Order Re Responsive Pleading (20CECG01302) WHEREAS, Petitioners and Plaintiffs State Water Contractors and Kern County Water Agency commenced the above-captioned action by filing a petition for writ of mandate against Respondents, Defendants, and Real Parties in Interest California Department of Water Resources (“DWR”) and California Department of Fish and Wildlife (“CDFW”) (DWR and CDFW collectively, “Respondents”); and WHEREAS, State Water Contractors, Kern County Water Agency, Antelope Valley-East Kern Water Agency, Central Coast Water Authority, Dudley Ridge Water District, County of Kings, Oak Flat Water District, Palmdale Water District, Santa Clarita Valley Water Agency, San Gabriel Valley Municipal Water District and Tulare Lake Basin Water Storage District 10 (collectively, “Petitioners” or “Plaintiffs”) have filed a First Amended and Verified Petition for 11 Writ of Mandate for Violation of the California Environmental Quality Act and California 12 Endangered Species Act; and Complaint for Breach of Contract, and Breach of the Implied 13 Covenant of Good Faith and Fair Dealing (First Amended Petition and Complaint), and there is 14 disagreement among the Parties as to the applicable due date for DWR to respond to Plaintiffs’ 15 non-mandamus causes of action; and 16 WHEREAS, Petitioners allege various claims in their First Amended Petition and 17 Complaint, including mandamus claims that Respondents violated the California Environmental 18 Quality Act (“CEQA”) and the California Endangered Species Act (“CESA”), and non-mandamus 19 claims against DWR based on contract theory; 20 WHEREAS, Respondents’ time to respond to the mandamus claims is governed by Code 21 of Civil Procedure section 1089.5; 22 WHEREAS, there is disagreement among the Plaintiffs and DWR as to the applicable due 23 date for DWR to respond to Plaintiffs’ non-mandamus causes of action; DWR’s position is that its 24 time to respond to the non-mandamus causes of action is governed by Code of Civil Procedure 25 section 1089.5, but nonetheless wishes to attempt to resolve this matter informally; 26 WHEREAS, the Parties wish to stay the time for responsive pleadings to the non-mandamus 27 causes of action for thirty (30) days from September 7, 2020, the date Plaintiffs contend the 28 responsive pleading is due, during which time the Parties will reach agreement and enter into a 2 Stipulation And [Proposed] Order Re Responsive Pleading (20CECG01302) further stipulation to clarify when responsive pleadings will be filed in response to the non- mandamus claims contained in the Petition, or ask the Court to resolve the issue; and WHEREAS, Petitioners and Respondents further desire to agree to electronic service in the above-captioned action; and WHEREAS, Code of Civil Procedure section 1010.6 and California Rules of Court, Rule 2.251 state that parties may agree to accept electronic service by serving a notice on all parties and other persons that the party or other person accepts electronic service and filing the notice with the court. IT IS THEREFORE STIPULATED by and among Plaintiffs and Respondents that: 10 1 To the extent it applies, DWR’s deadline to file a responsive pleading to the non- 11 mandamus causes of action is stayed for thirty (30) days from September 7, 2020, during which 12 time the parties shall work to reach agreement and enter into a further stipulation to clarify when 13 responsive pleadings will be filed or present the issue to the Court. 14 2 Petitioners and Respondents stipulate and consent to accept electronic service of 15 filings and other documents in the above-captioned matter, pursuant to Code of Civil Procedure 16 section 1010.6 and California Rules of Court, Rule 2.251. This stipulation shall apply only to the 17 service of documents between the undersigned parties.
