On November 7, 2017, a Case Management Conference was held on Defendant’s Demurrer to the Complaint in Department 2 of this Court before the Honorable Marie S. Weiner. David Leimbach of Schneider Wallace Cottrell Konecky Wotkyns LLP appeared on behalf of Plaintiff Moniz; andChristina Teeter of Latham & Watkins‘LLP appeared on behalf of Defendant Adecco USA Inc. Counsel for the parties reported that Judge Karnow of San Francisco County Superior Court was assigned as the Coordination Motion Judge on the pending Petition for Coordination, that Judge Karnow took off calendar the coordination hearing indicating that his decision on the pending demurrer in the Doe case will impact his decision on coordination, that no new date has yet been set for the coordination hearing, and that Judge Karnow has not issued a decision on the pending demurrer which was set for hearing today. The Court encouraged the parties to conduct initial discovery which will need to , occur regardless of coordination. Counsel also indicated that they will be submitting a stipulated confidentiality order. The Court made the following rulings at the Conference, which are set forth herein as the formal order of this Court. IT IS HEREBY ORDERED as follows: 1. A Discovery Conference is set for Tuesday, December 12, 2017 at 2:00 p.m. in Department 2 of this Court, to discuss ALL outstanding discovery disputes. Counsel for the parties shall directly submit to Department 2, and serve upon counsel for all parties, a short letter brief on outstanding issues, afier meet and confer, with supporting, information for the Court, on or before December 5, 2017. If there are no discovery disputes, counsel should so notify the Court and the Discovery Conference will be taken off calendar. 2. A Case Management Conference is set for Tuesday, December 12,2017 at 2:00 p.m. in Department 2 of this Court, located at Courtroom 2E, 400 County Center, Redwood City, California. 3. In anticipation of the Case Management Conference, counsel for the parties should be prepared to discuss at the hearing and file written case management conference statements (in prose and details, not using the standardized Judicial Council form) with a courtesy copy delivered directly to Department 2 on or before December 5, 2017, as to the following: a. Status of Petition for Coordination, and Status of Doe, case; 'b. Status of Discovery, including the deposition of Plaintiff and the initial production of documents by all parties; Status of Settlement or Mediation; Any anticipated motions and proposed briefing schedule; Setting of next CMC date; and DATED: November 7, 2017 W/ Any other matters for which the parties seek Court ruling or scheduling.
