AGREED FINAL JUDGMENT
BE IT REMEMBERED that on this date came to be considered the above styled and
numbered cause filed on May 4, 2017. Plaintiff, the State of Texas, was represented by its
Assistant District Attorney for Harris County, Texas. Respondent YANICK SEMEDO LOPES
PEREIRA, owner and possessor of the ONE 2008 TRIUMPH MOTORCYCLE, was
represented by Michael E. Stoll. The parties notified the Court that an agreement had been
reached. The Court has jurisdiction of the subject matter and parties, and a Final Judgment
should be granted herein. It is therefore:
ORDERED, ADJUDGED, AND DECREED that the ONE 2008 TRIUMPH
MOTORCYCLE, VIN: 2MTDO1NE18J325081, is subject to forfeiture but by agreement of the
parties is to be returned to Respondent YANICK SEMEDO LOPES PEREIRA, or his
authorized representative, in exchange for the consideration of $1,000.00, to be paid in full by
Respondent YANICK SEMEDO LOPES PEREIRA to the Harris County District Attorney’s
Office before the submission of this judgment to the Court, and after Respondent YANICK
SEMEDO LOPES PEREIRA has paid all towing and storage fees, if any, which have accrued
against the ONE 2008 TRIUMPH MOTORCYCLE, VIN: 2MTDOINE18J325081. It is
FURTHER ORDERED that the $1,000.00 is forfeited: all to be administered by the Harris
County District Attorney’s Office for the law enforcement agencies and Harris County incompliance with their local agreement, the Code of Criminal Procedure, Article 59.06(c), and
audited in accordance with Article 59.06(g).
Plaintiff pays no court costs in accordance with Article 59.05(f) of the Texas Code of
Criminal Procedure. Respondent YANICK SEMEDO LOPES PEREIRA is charged with all
costs of court incurred by him, if any. All relief not granted herein is denied. This judgment
finally disposes of all parties and all claims and is appealable.
