The Petition for instructions Regarding the Management of the Settlor's Real
Property and Finances (the “Petition for Instructions”) of Herb Thomas, as Successor
Trustee of the Rosia L. Hart Revocable Trust (the “Trust"), having come regularly for hearing
on February 11, 2013 before the Honorable Lillian K, Sing; Bruce A. Feder, Esq. of Kato,
Feder & Suzuki having appeared for Rosia L. Hart, the Settfor; Andrew K. Schultz, Esq. of
ORDER FOR INSTRUCTIONS T Case No. PTR-06-288755Witherspoon & Siracusa having appeared for Herb Thomas; and good cause appearing
therefor:
THE COURT FINDS that the tequirement to provide notice of the Petition for tnstruc-
tlons to Gregory Wiggins, beneficiary of the Rosia L. Hart Revocable Trust, may be waived; aif
other notices have been given as required by law.
THEREFORE, IT iS ORDERED that:
1. No further notice of the Petition for Instructions is required;
I 2. The requirement to provide notice of the Petition for instructions to trust
beneficiary Gregory Wiggins is waived;
3. tn the Order Appointing Probate Conservator dated November 16, 2006 in the
related conservatorship proceedings, Rosia L. Hart, the Settior, was authorized to have a
personal checking account, receive her monthly Social Security and pension payments, and
pay all of her own regular household bills and expenses, which she has done and continues to
do, and she is hereby authorized to make the monthly mortgage payment of approximately
$520 for her residence located at 3133 Crestline Court, Antioch, Califomia from her personal
account as well; Mrs. Hart will authorize the bank holding the mortgage for 3133 Crestline
Court to speak directly with the Trustee regarding the mortgage and to provide the Trustee
with a duplicate monthly mortgage statement;
4 The Settlor's commercial income property located at 950 Newhall Street, San
Francisco, California will be retained in the Trust, the Trustee will continue to manage the
Property, and he will make efforts, with the assistance of (rs. Hart, to rent the second
commercial space in the property;
5. Once transferred from the conservatorship, although under-productive at this
time, the Settlor's residential rental property located at 1760 Dover Circle, Suisun City,
California will be retained in the Trust and managed by the Trustee, including collecting the
rent and paying the mortgage, and Mrs. Hart will authorize the bank holding the mortgage to

and
6. The parties have agreed to the terms underlying this Order based on current
circumstances and without waiving any existing rights, and any of the terms of this Order may
