1, ANDREW L.: SMITH, declare:
Lam the proposed successor trustee and a beneficiary under the trust amendment
submitted. by Rosia. Lee Hart for this court’s approval and I submit this declaration in support of
Rosia Lee Hart’s petition to amerid her trust, By this declaration | am providing the court with
information that will assist.the court in understanding my relationship with Ms..Hart and my
qualifications to. serve as the successor trustee of her trust.
Thave known Ms, Hart for-as long as'I can remember. My mother and Ms. Hart were best
of friends even before | was born, and Ms, Hart has always been a strong and positive influence
on me, particularly as. | was growing up: My parents raised my five siblings and.me with

discipline, faith, and a sound work ethic; all values shared with Ms. Hart, Along with my
parents, Ms. Hart instilled in me the importance of friends and family, hard work, strong faith,
and working to achieve one’s goals. These are values that | have shared with my wife of forty-
three years, and which have guided us as we have raised our own family, including our two
children, both of whom have graduated from college and secured gainful employment,
We currently reside in Antioch, after having lived in San Francisco for seventeen years,
and have been in our residence now for twenty-five years. My wife and I have worked hard over
the length of our careers and have purchased rental properties of our own, which we successfully
manage ourselves. Since Ms. Hart also resides in Antioch, it is convenient for me to visit with
her or help her with her errands when she needs assistance. As a Pastor of the Litde Bethany
Missionary Baptist Church in San Francisco where Ms. Hart is a congregant, J can also transport
Ms. Hart to and from church as she requests. Ms, Hart has confidence in my skills and
experience and has consistently indicated that she would prefer that I serve as the trustee of her
trust. [am willing to serve in that capacity.
Although I have retired from active employment, my work history has provided me with
the experience necessary to manage and administer the assets owned by Ms. Hart's trust. After
attending college, 1 began a career in the building trades, securing my electrical contractor’ s
license at age twenty-one. I worked in a variety of construction areas until I went to work for
PG&E when I was twenty-four years old. | started with construction crews for PG&E and
worked my way up until I eventually entered PG&E’s management level where I managed large
construction projects and my responsibilities included planning, organizing, budgeting, safety,
staffing, and other related tasks. After working for PG&E for thirty-three years | retired (rom the
company at age fifty-five, and pursued my interest and dedication to the church.
I served as Deacon in the same church for nineteen years, and was called to Pastor in
2000. I constantly pursued educational opportunities to better prepare and train me for my
pastoral work. In May of 2003 | received the degree of Associate of Biblical Studies from the
Sacramento Theological Seminary and Bible College. Two years later I earned a Bachelor’s of
