PLAINTIFF’S MOTION FOR NEW TRIAL
NOW COMES Plaintiff, Cypresswood & Fairfield Village II, Ltd., Movant herein, in the
interest of justice and fairness, and brings this Motion for New Trial. In support hereof, Movant
shows the following:

The Trial Court should hear from witness’ put on by the plaintiff: i.e. — the plaintiff and
their agent regarding the authority and contract entered into by the parties. (The Court noted it
would like to know what the agreement of the parties was. Furthermore the plaintiff should be
allowed to call a Harris County Appraisal District representative to discuss if and when an error
is made how said error would be corrected. The Court raised that question regarding what letter
would be received and how to correct the error.)
The Plaintiff believes if the Court grants this motion this evidence is so material it will
probably produce a different result form the Court

Movant includes affidavit attached hereto, as proof of the allegations herein, and
incorporates said affidavit by reference.
