RE: Ly v. Sage Intacct, Inc.
CASE NUMBER: 18CV334378
ORDER AND NOTICE OF INFORMAL DISCOVERY CONFERENCE
An informal discovery conference for the above-entitled case has been set and you are directed to
appear as follows:
Date: November 4, 2019 At: 3:30 p.m. In: Department1
Location: Superior Court, 191 North First Street, San Jose, CA 95113.
The above conference has been scheduled by the Court at the request of the parties. The parties’
discovery meet and confer obligations require an in-person conference in all but extraordinary
circumstances. If the parties are unable to resolve their disoute, they are required to meet and
confer with the Court, informally, prior to filing a discovery motion, unless otherwise authorized by the
Court. Each side must serve and lodge a short brief, on pleading paper and limited to no more than
3 pages, briefly discussing the issues to be addressed — by noon, at least two court days prior to the
conference. No exhibits may be attached to the brief. The purpose of the brief is to provide the Court
with an overview of the outstanding issues and is not to be used in place of a motion.
Personal appearances are required. Lead counsel with full authority to resolve the discovery dispute
must attend unless excused by the Court.
Any dates given by the Court relating to informal discovery conferences have no effect on statutory
deadlines for filing motions or any other papers, including, but not limited to, the 45-day deadline for
filing a motion to compel further responses. The parties may, however, agree to extend statutory
deadlines pursuant to Code of Civil Procedure section 2024.060.
