                              MOTION FOR LEAVE TO DESIGNATE RESPONSIBLE THIRD PARTY
                          On this day came to be considered Defendant, Waste Management of Texas, Inc.’s

                Motion         for Leave to Designate Responsible Third Party (“Motion”).            After reviewing the

                Motion, and after considering same, the arguments of counsel, the pleadings and the evidence on

                file, if any, the Court is of the opinion that the Motion should be in all things GRANTED.

                          Accordingly,       it is therefore ORDERED,       ADJUDGED    AND        DECREED           that Waste

                Management of Texas, Inc.’s Motion is hereby GRANTED.             It is further,

                          ORDERED, ADJUDGED             AND DECREED that Anastasio Roth is hereby designated as

                Responsible Third Party in this cause and shall accordingly have his respective percentage of

                responsibility determined by the trier of fact pursuant to the Texas Civil Practice and Remedies

                Code § 33.003.
