Ortega, appeared in person through their attorney and announced ready for trial. Defendant
Anastasios C. Roth failed te appear for trial. It appears to the Court that citation was personally
served on Defendant Anastasios C. Roth and returned in accordance with the provisions of Rules
106 and 107 of the Rules of Civil Procedure and that defendant has not appeared or answered
with respect te this matter. The citation, bearing the officer’s return, has been on file with the
clerk for ten days, exclusive of the day of filing and this day. The parties submitted all matters in
controversy, legal and factual, to the Court. The Court heard the evidence and arguments of
counsel and readers judgment for Plaintiff.
Therefore, the Court orders that Plaintiffs Jose Ortega and Estela Ortega, recover from
Defendant Anastasios C. Roth, the sum of $20,000, prejudgment interest on that sum at the
annual rate of 5% in the sum of $3,152, post-judgment interest on the total sum at the annual rate
of 5%, and court costs.
Plaintiffs request exemplary damages against Defendant Anastasios C. Roth for his breach of
fiduciary duties to Plaintiffs and ask the Court to award exemplary damages in the amount of
