                                        ORDER OF DISMISSAL

        The    Joint Motion     to Dismiss     of Plaintiff,   Sally   Burns,   Independent   Executrix   of the

Estate of Willie Mae Nacol,        deceased,    and Davis Family        Living Trust, Defendant     and Third-

Party Plaintiff herein, having come on for consideration by the Court, and the Court being of the

opinion such motion should be GRANTED,                  it is accordingly, ORDERED,           ADJUDGED       and

DECREED as follows:

        1     The claims of Plaintiff in the above case against Davis Family                  Living Trust are

              dismissed with prejudice.

              The claims of Davis Family Living Trust against Marie Gilbert are dismissed without

              prejudice to the refiling of same at a later date.

        All costs of court are assessed against the party incurring the same.           All costs having been

paid, let no execution issue.
