At all times herein relevant, Plaintiff WAWANESA GENERAL INSURANCE 23 COMPANY ("Plaintiff' or "Wawanesa") was a corporation duly qualified to do business in the 24 State of California as an insurance company and is authorized to engage in business in the County 25 of Los Angeles. 26 2. Plaintiff is informed and believes, and thereon alleges, that at all times herein 27 relevant, Defendants VIGENTSATURYAN, ARTINTSATURYAN and ARMOND 28 TSATURYAN were residents of the County of Los Angeles, State of California. COMPLAINT FOR DECLARATORY RELIEF 1 3. Plaintiff is ignorant of the true names and capacities of the individuals or entities 2 sued herein as DOES 1 through 20, who may have been involved in the acts alleged herein. 3 Plaintiff alleges that each of the DOE defendants sued herein is legally responsible in some 4 manner for the events and happenings referred to herein, and the Plaintiff's damages as alleged 5 were proximately caused by their conduct. Plaintiff therefore sues said Defendants by such 6 fictitious names and will ask leave of court to amend this Complaint to show their true names and 7 capacities when the same has been ascertained. 8 4. At all times herein, Defendants and each of them were the agents, servants, and 9 employees of each Defendant, and in doing the things herein described, were acting within the 10 course and scope of their authority as such agents, servants, and employees. z~ <(o 11 5. There are two prior actions filed in Los Angeles County Superior Court that arise 12 from the same set of facts that are the basis for this action for Declaratory Relief, which stem from ~~ ....J 13 an alleged automobile collision of March 21, 2016 ("the Collision"). As set forth below, in Los Q3 u~ 14 Angeles Superior Court Case No. BC653561, entitled Vigen Tsaturyan, et al. v. Sergo Kutelia, et 15 al., plaintiffs filed a personal injury action alleging bodily injuries and property damage as a result ~ 16 of the Collision. Los Angeles Superior Court Case No. 19STCP01840, entitled Vigen Tsaturyan 17 and Artin Tsaturyan v. Wawanesa Insurance Company, is a petition for an order compelling 18 arbitration in connection with the plaintiffs/petitioners' uninsured motorist claim with Wawanesa 19 stemming from the Collision. These two cases are referred to as the "Underlying Actions." 20 6. Plaintiff is informed and believes, and thereon alleges, that the Underlying Actions, 21 as more particularly set forth below, arise from a staged auto accident, and :fraudulent activity by 22 Defendants, and each of them. Plaintiff thus seeks declaratory relief by way of this action that it 23 owes no coverage to Defendants and owes no further duties under the subject Wawanesa policy 24 and also seeks an Order staying the arbitration hearing by way of a separate motion filed 25 concurrently in Case No. 19STCP01840. 26 BACKGROUND FACTS; THE UNDERLYING ACTIONS 27 7. On March 21, 2016, defendants allege they were involved in an automobile 28 collision with Sergo Kutelia. Defendant Vigen Tsaturyan was the alleged driver of a 2008 2 COMPLAINT FOR DECLARATORY RELIEF 1 Mercedes Benz E350, and defendant Artin Tsaturyan was a passenger. This is described herein as 2 the "Collision". There is an issue at hand as to whether the Collision occurred as claimed or at all. 3 Vigen Tsaturyan was insured under a policy of auto insurance issued by Plaintiff. Defendant 4 Armond Tsaturyan was the registered owner of the Mercedes. The Mercedes was an insured 5 vehicle under the Wawanesa policy. Sergo Kutelia was the alleged driver of a 2002 BMW 525i 6 and was insured under an auto liability policy issued by State Fann Mutual Automobile Insurance 7 Company. The Collision reportedly took place at Bryant Street and Darby Avenue in Northridge, 8 California. A true and accurate copy of the Wawanesa policy ("Policy") is attached as Exhibit 1. 9 8. Sergo Kutelia admitted fault for the alleged Collision. Defendants made bodily 10 injury and property damage claims with Kutelia's carrier, State Fann. On March 7, 2017, Vigen z~ <(o 11 Tsaturyan and Artin Tsaturyan filed a Complaint against Sergo Kutelia, LASC Case No. 12 BC653561. On July 7, 2017, State Fann :filed a Complaint for Declaratory Relief against ~~ o~ -I u~ 13 defendants Sergo Kutelia, Vigen Tsaturyan, Artin Tsaturyan and Armond Tsaturyan, LASC Case 14 No. BC667650. The State Fann complaint sought a judgment against Kutelia that no rights, duties 15 or obligations arose or existed under the State Fann Mutual auto policy, or that any benefits or ~ 16 coverage existed for Vigen Tsaturyan, Artin Tsaturyan, or Armond Tsaturyan. 17 9. On or about March 19, 2018, State Fann obtained a default judgment against 18 Kutelia and the Tsaturyans as these defendants failed to respond or appear in the action. The 19 signed judgment indicated that Kutelia breached the Insured's Duties policy condition, failed to 20 cooperate with State Fann, breached the Concealment and Fraud policy condition, and thus State 21 Fann owed no benefits, coverage, further duties or responsibilities to Kutelia from the March 21, 22 2016, loss. Further, State Fann had no duty or derivative responsibility to Vigen Tsaturyan, Artin 23 Tsaturyan, or Armond Tsaturyan for claims arising from the March 21, 2016, loss, and that the 24 Collision of March 21, 2016, did not occur as claimed and thus did not constitute "an Accident" 25 under the terms of the State Fann policy. 26 10. On May 10, 2019, Vigen Tsaturyan and Artin Tsaturyan filed a Petition for Order 27 Compelling Uninsured Motorist Arbitration against Wawanesa, LASC Case No. 19STCP01840, 28 as a result of State Farm's default judgment and declaration of no coverage under Kutelia's State 3 COMPLAINT FOR DECLARATORY RELIEF 1 Farm policy. The petition was set for hearing on November 4, 2019. The Court's tentative ruling 2 was to grant the petition. The parties submitted on the tentative which became the final order of 3 the Court. 4 11. State Farm and Wawanesa conducted investigations regarding the subject claim. 5 Among other items of concern to Wawanesa, defendants failed to present for Examinations Under 6 Oath as required by the Policy, defendants Vigen and Artin Tsaturyan provided inconsistent and 7 conflicting information regarding their injuries and medical treatment as a result of the collision, 8 the 2008 Mercedes Benz E350 had a history of property damage, including a total loss on January 9 12, 2013, the Mercedes previously had a ''junk" title before its acquisition by defendant Armond 10 Tsaturyan, and defendants Vigen Tsaturyan, Artin Tsaturyan and Armond Tsaturyan each has a 11 significant recent clams history. 12 12. Plaintiff now brings this Declaratory Relief action, contending that no benefits or 13 coverage exist under the Uninsured Motorist provisions of the Policy for defendants based on the 14 alleged staged accident of March 21, 2016, the fraud and non-cooperation provisions of the Policy. 15 FIRST CAUSE OF ACTION 16 DECLARATORY RELIEF AGAINST ALL DEFENDANTS 17 13. Plaintiff incorporates by reference Paragraphs 1 through 12 of this Complaint as 18 though fully set forth herein. 19 14. On or about May 8, 2015, Wawanesa issued a policy of automobile insurance to 20 named insured Vigen Tsaturyan, Policy Number 10023940, which contained Uninsured Motorist 21 coverage limits of $30,000 per person and $60,000 per each occurrence. A true and accurate copy 22 of the Policy is attached as Exhibit 1. 23 15. On or about March 24, 2016, Wawanesa received first notice ofloss in connection 24 with the alleged collision of March 21, 2016. The loss was assigned claim number 01270350. On 25 May 24, 2018, in a letter to claimants' counsel, Wawanesa acknowledged claimants' counsel's 26 forthcoming demand for payment under the Uninsured Motorist Bodily Injury provisions of the 27 Policy. 28 /// 4 COMPLAINT FOR DECLARATORY RELIEF 1 16. An actual controversy has arisen and now exists between Wawanesa and Defendants, 2 and each of them, as to the existence of coverage available under the Policy, in light of Plaintiff's 3 loss investigation and evidence that the loss of March 21, 2016, did not occur as claimed, and was 4 made for the purpose of committing fraud. 5 17. By and through this Complaint, and in keeping with its statutory obligations under 6 the California Insurance Code, Wawanesa seeks relief necessary for a declaration that it owes no 7 coverage, further duties or responsibilities to Defendants under the Policy. 8 WHEREFORE, Plaintiff Wawanesa prays for relief as follows: 9 1. For a judicial declaration that no coverage is owed under Wawanesa General 10 Insurance Policy No. 10023940 for Defendants in relation to the reported Collision of March 21, z~ <(o 11 2016 giving rise to Wawanesa claim number 01270350; ~; 12 2. Bodily Injury Liability - Mandatory Coverage This coverage protects you against loss of your home, income and life savings (financial loss) should your vehicle injure or kill anyone and you are legally liable. Throughout this policy "you" and "your" refer to the "named insured" on the Policy Declarations; and 1. The spouse, or 2. A person who is a registered domestic partner under California law with the "named insured"; if a resident of the same household. B. This includes a ward or foster child. G. "Occupying" means in, upon, getting in, on, out or off. H. "Property Damage" means physical injury to, destruction of or loss of use of tangible property. I. 'Trailer" means a vehicle designed to be pulled by a: 1. Private passenger auto; or 2. Pickup or van. It also means a farm wagon or farm implement while towed bya vehicle listed in 1. or 2. above. J. "Your covered auto" means: 1. Any vehicle shown in the Declarations. 2. A "newly acquired auto". 3. Any "trailer" you own. 4. Any auto or "trailer" you do not own while used as a temporary substitute for any other vehicle described in this definition which is out of normal use because of its: a. Breakdown; b. Repair; c. Servicing; d. Loss; or e. Destruction. K. "Non-owned auto" means any of the following types of vehicles not owned by or furnished or available for the regular use of you or any "family member" while in the custody of or being operated by you or any "family member": 1. A private passenger auto; or 2. "Trailer"; or 3. A pickup or van, for which no other insurance policy provides coverage, that: a. Has a Gross Vehicle Weight of less than 10,000 lbs.; and b. Is not used for the delivery or transportation of goods and materials unless such use is for farming or ranching. Breakdown; 2. Repair; 3. Servicing; 4. Loss;or 5. Destruction. L. "Newly acquired auto": 1. "Newly acquired auto" means any of the following types of vehicles you become the owner of during the policy period: a. A private passenger auto; or b. A pickup or van, for which no other insurance policy provides coverage, that (1) Has a Gross Vehicle Weight of less than 10,000 lbs.; and (2) Is not used for the delivery or transportation of goods and materials unless such use is for farming or ranching. 2. Coverage for a "newly acquired auto" is provided as described below. If you ask us to insure a "newly acquired auto" after a specified time period described below has elapsed, any coverage we provide for a "newly acquired auto" will begin at the time you request the coverage. a. For any coverage provided in this policy except Coverage For Damage To Your Auto, a "newly acquired auto" will have the broadest coverage we now provide for any vehicle shown in the Declarations. Coverage begins on the date you become the owner. However, for this coverage to apply to a "newly acquired auto" which is in addition to any vehicle shown in the Declarations, you must ask us to insure it within 30 days after you become the owner. If a "newly acquired auto" replaces a vehicle shown in the Declarations, coverage is provided for this vehicle without you having to ask us to insure it. b. Collision Coverage for a "newly acquired auto" begins on the date you become the owner. However, for this coverage to apply, you must ask us to insure it within: (1) 30 days after you become the owner if the Declarations indicate that Collision Coverage applies to at least one auto. In this case, the "newly acquired auto" will have the broadest coverage we now provide for any auto shown in the Declarations. (2) Four days after you become the owner if the Declarations do not indicate that Collision Coverage applies to at least one auto. If you comply with the 4 day requirement and a loss occurred before you asked us to insure the "newly acquired auto", a Collision deductible of $500 will apply. c. Comprehensive Coverage for a "newly acquired auto" begins on the date you become the owner. However, for this coverage to apply, you must ask us to insure it within: (1) 30 days after you become the owner if the Declarations indicate that Comprehensive Coverage applies to at least one auto. In this case, the "newly acquired auto" will have the broadest coverage we now provide for any auto shown in the Declarations. (2) Four days after you become the owner if the Declarations do not indicate that Comprehensive Coverage applies to at least one auto. If you comply with the 4 day requirement and a loss occurred before you asked us to insure the "newly acquired auto", a Comprehensive deductible of $500 will apply. M. "Relative" means a person related to you by blood, marriage, registered domestic partnership under California law or adoption. This includes a ward orfosterchild. N. "Personal vehicle sharing" means the use of "your covered auto" by persons other than the vehicle's owner, in connection with a "personal vehicle sharing program". O. "Personal vehicle sharing program" means a legal entity qualified to do business in the State of California engaged in the business of facilitating the sharing of "your covered auto" for noncommercial use by individuals within the state. We will pay damages for "bodily injury" or "property damage" for which any "insured" becomes legally responsible because of an auto accident. Damages include prejudgment interest awarded against the "insured". We will settle or defend, as we consider appropriate. any claim or suit asking for these damages. In addition to our limit of liability, we will pay all defense costs we incur. Our duty to settle or defend ends when our limit of liability for this coverage has been exhausted by payment of judgments or settlements. We have no duty to defend any suit or settle any claim for "bodily injury" or "property damage" not covered under this poficy. B. "Insured" as used in this Part means: 1. You or any "family member" for the ownership, maintenance or use of any auto or "trailer". 2. Any person using "your covered auto". 3. For "your covered auto". any person or organization but only with respect to legal responsibility for acts or omissions of a person for whom coverage is afforded under this Part. 4. For any auto or "trailer" other than "your covered auto", any other person or organization but only with respect to legal responsibility for acts or omissions of you or any "family member" for whom coverage is afforded under this Part. This provision (B.4.) applies only if the person or organization does not own or hire that auto or "trailer". SUPPLEMENTARY PAYMENT In addition to our limit of liability, we will pay on behalf of an "insured": 1. Up to $250 for the cost of bail bonds required because of an accident, including related traffic law violations. The accident must result in "bodily injury" or "property damage" covered under this policy. 2. Premiums on appeal bonds and bonds to release attachments in any suit we defend. 3. Interest accruing after a judgment is entered in any suit we defend. Our duty to pay interest ends when we offer to pay that part of the judgment which does not exceed our limit of liability for this coverage. 4. Up to $200 a day for loss of earnings, but not other income, because of attendance at hearings or trials at our request. 5. Other reasonable expenses incurred at our request. EXCLUSIONS A. We do not provide liability Coverage for any "insured" nor do we owe a duty to defend any"insured": 1. For "bodily injury" to you or any "family member" whenever the ultimate benefits of indemnification accrue directly or indirectly to you or any "family member". 2. Who intentionally causes "bodily injury" or "property damage". 3. for "property damage" to property owned or being transported by that "insured". 4. for "property damage" to property: a. Rented to; b. Used by; or c. In the care of; that "insured". This Exclusion (A.4.) does not apply to "property damage" to a residence or private garage. 5. for "bodily injury" to an employee of that "insured" during the course of employment. This Exclusion (A.5.) does not apply to "bodily injury" to a domestic employee unless workers' compensation benefits are required or available for that domestic employee. 6. For that "insured's" liability arising out of the ownership or operation of a vehicle while it is being used to carry persons or property for a fee. This Exclusion (A.6.) does not apply to a share-the-expense car pool. While employed or otherwise engaged in the "business" of: a. Selling b. Repairing c. Servicing d. Storing; or e. Parking; Vehicles designed for use mainly on public highways. This includes road testing and delivery. This Exclusion (A.7.) does not apply to the ownership, maintenance or use of "your covered auto" by: a. You; b. Any "family member"; or c. Any partner, agent, or employee of you or any "family member". 8. Maintaining or using any vehicle while that "insured" is employed or otherwise engaged in any "business" (other than farming or ranching) not described in Exclusion (A.7.). This Exclusion (A.8.) does not apply to the maintenance or use of: a. Private passenger auto; b. Pickup or van that you own; or c. "Trailer" used with a vehicle described in a. or b. above. 9. Using a vehicle without permission from the owner to do so or beyond the scope of that permission. This Exclusion (A.9.) does not apply to a "family member" using "your covered auto" which is owned by you. 10. for "bodily injury" or "property damage" for which that "insured": a. Is an insured under a nuclear energy liability policy;or b. Would be an insured under a nuclear energy liability policy but for its termination upon exhaustion of its limits of liability. A nuclear energy liability is a policy issued by any of the following ortheirsuccessors: a. Nuclear Energy Liability Insurance Association; b. Mutual Atomic Energy Liability Underwriters; or c. Nuclear Insurance Association of Canada. 11. for any liability assumed by any "insured" under a contract or agreement outside the terms of this policy. B. We do not provide Liability Coverage nor a duty to defend for the ownership, maintenance or use of: 1. Any vehicle which: a. Has fewer than four wheels; or b. Is designed mainly for use off public roads. This Exclusion (B.1.) does not apply to any "trailer". 2. Any vehicle, other than "your covered auto", which is: a. Owned byyou;or b. Furnished or available for your regular use. 3. Any vehicle, other than "your covered auto", which is: a. Owned by any "family member"; or b. Furnished or available for the regular use of any ''family member''. However, this Exclusion (B.3.) does not apply to you while you are maintaining or "occupying" any vehicle which is: a. Owned by a "family member''; or b. Furnished or available for the regular use of a "family member". 4. Any vehicle, while used for the purpose of: a. Competing in; or b. Practicing or preparing for; any prearranged or organized racing, speed, demolition contest or stunting activity. 5. Any vehicle, while used for the purpose of wholesale or retail delivery. "Your covered auto" while: a. Enrolled in a "personal vehicle sharing program" under the terms of a written agreement; and b. Being used in connection with such "personal vehicle sharing program" by anyone other than you or any "family member". LIMIT OF LIABILITY A. The limit of liability shown in the Declarations for each person for Bodily Injury Liability is our maximum limit of liability for all damages, including but not limited to damages for care, loss of consortium, loss of services, loss of companionship, loss of society and loss by death, arising out of "bodily injury" sustained by any one person in any one auto accident. Subject to this limit for each person, the limit of liability shown in the Declarations for each accident for Bodily Injury Liability is our maximum limit of liability for all damages for "bodily injury" resulting from any one auto accident. The limit of liability shown in the Declarations for each accident for Property Damage Liability is our maximum limit of liability for all "property damage" resulting from any one auto accident. This is the most we will pay regardless of the number of: 1. "lnsured's"; 2. Claims made; 3. Vehicles or premiums shown in the Declarations; 4. Vehicles involved in the auto accident; 5. Lawsuits brought; or 6. Vehicles insured. B. Any amounts paid or payable under this coverage shall be reduced by any amounts paid for the same expenses and/or damages under Part II or Part V of this policy. , C. Permissive Driver Limitation. We will provide liability coverage under this section for an insured, other than you, a "family member" or a "relative", up to but not exceeding the limits of the Financial Responsibility Law of the State of California, which are as follows: 1. Fifteen thousand dollars ($15,000) for "bodily injury" to, or death of each person as a result of any one accident; and 2. Subject to the limit as to each person (refer to C.1.) the amount of thirty thousand dollars ($30,000) for "bodily injury" to, or death of all persons as a result of any one accident; and 3. The amount of five thousand dollars ($5,000) for damage to property of others as a result of any one accident.
