APPLICABILITY AND SCOPE OF ORDER 26 1. This Implementation Order (“Order”) applies only to Plaintiffs who have asserted 27 or seek to assert personal injury claims related to the use of one or more of Defendants’ social [PROPOSED] CASE MANAGEMENT ORDER NO. 4– STIPULATED IMPLEMENTATION ORDER 28 GOVERNING ADOPTION OF MASTER COMPLAINT (PERSONAL INJURY) AND SHORT-FORM COMPLAINTS 1 media apps1 (“Personal Injury Plaintiffs”) consistent with the scope of the Order initiating this 2 JCCP.2 No personal injury claims may be asserted in current or future cases coordinated in this 3 JCCP other than pursuant to the terms of this Order. This Order applies to cases coordinated in this 4 JCCP proceeding. This Order is binding on all Parties and their counsel in all such cases. This Order 5 is not intended to alter the applicable provisions of the Code of Civil Procedure or the Rules of 6 Court, except as specified herein. By entering into this Order, Defendants do not waive any 7 defenses, including jurisdictional and venue challenges, to any claims made in this JCCP. 8 II. MASTER PLEADINGS 9 A. MASTER COMPLAINT (PERSONAL INJURY) 10 1. Timing. Pursuant to Case Management Order No. 2 (“CMO-2”), the Plaintiffs’ 11 Steering Committee (PSC) filed a Plaintiffs’ Master Complaint (Personal Injury) (“Master 12 Complaint”) on May 15, 2023. 13 2. Effect of Master Complaint. All claims pleaded in the Master Complaint will 14 supersede and replace all claims for personal injury in any action pending in this JCCP. Nothing in 15 this Order shall preclude the PSC from seeking leave to amend the Master Complaint as provided 16 in the Code of Civil Procedure or preclude any Defendant from opposing such leave. 17 B. SHORT-FORM COMPLAINT 18 3. Attached as Exhibit A to this Order is a template form Short-Form Complaint 19 (“SFC”) for use by personal injury Plaintiffs in current and future personal injury cases added-on 20 to this JCCP. 21 4. The SFC is an abbreviated form that each individual Plaintiff will complete, 22 indicating their individual claims, the Defendants against whom they are bringing those claims, and 23 adopting the applicable factual allegations set forth in the Master Complaint as the basis for those 24 individual claims. Each Plaintiff who claims injury arising from their own use of Defendants’ 25 1 26 Plaintiffs allege in the Master Complaint and their proposed Short Form Complaint that the social media apps are “products.” Nothing in this Case Management Order or in the template Short Form Complaint shall be construed as an admission by any Defendant that their social 27 media platform(s) are products for purposes of any claim asserted by any Plaintiff. 2 28 This Order does not apply to Government entity cases filed by School Districts. [PROPOSED] CASE MANAGEMENT ORDER NO. 4– STIPULATED IMPLEMENTATION ORDER GOVERNING ADOPTION OF MASTER COMPLAINT (PERSONAL INJURY) AND SHORT-FORM COMPLAINTS 1 platforms shall file a separate SFC setting forth their individual claims and injury.3 Plaintiffs 2 asserting loss of consortium claims as permitted by law; parents or guardians of a minor Plaintiff 3 as permitted by law; and in the event of a wrongful death action, the appropriate heirs or 4 representative(s) of the Estate, may state their claims on the same SFC as the individual Plaintiff 5 whose use of Defendants’ platforms gives rise to their claims. By this process, all allegations 6 applicable to the specific Defendants by the specific Plaintiff named in the SFC that are set forth in 7 the Master Complaint shall be deemed pleaded against those Defendants. 8 5. For each such personal injury action, the Master Complaint (and any subsequent 9 amendments) and the SFC (and any subsequent amendments) shall be deemed the Plaintiff’s 10 operative Complaint. 11 6. Each SFC filed in this JCCP proceeding shall indicate the Superior Court where the 12 individual Plaintiff(s) originally filed their Complaint and the case number. 13 7. The procedures for filing the Master Complaint and the SFC do not reflect that the 14 Defendants have agreed to or admitted the allegations set forth in those pleadings, nor have the 15 Defendants conceded or waived their right to dispute the legal validity of the claims alleged therein. 16 8. Timing and Effect of Filing Short Form Complaints 17 a. Complaints Coordinated to this JCCP Before the Filing of this Order. 18 On or before June 15, 2023, Plaintiffs in any action added on to the JCCP on or before the date of filing 19 of this Order shall file the Short Form Complaint in any Member Case. For purposes of statutes of 20 limitations and statutes of repose, any such Plaintiff shall be deemed to have filed their complaint as of 21 the date they filed their original complaint and not the date of the Master Complaint or the date they 22 filed the SFC. Nothing in this Order or the filing of a SFC shall be construed as a prior dismissal or 23 amendment of a prior complaint, but the prior complaint shall no longer be deemed the operative 24 complaint. 25 26 3 27 This includes individual plaintiffs named in multi-plaintiff actions. However, Defendants reserve all rights to object to, and defenses to, multi-plaintiff actions. Defendants specifically 28 object to any suggestion that multi-plaintiff trials may be held in this matter.
