14 Quanyu Huang (“Ho Plaintiffs”) (collectively “Plaintiffs”) and Defendants Gregory J.
15 Davis, Kevin Wolfe, Jason Justesen, Paramont Capital, LLC, Paramont Woodside,
16 LLC, SVRV 385 Moore, LLC, and SVRV 387 Moore, LLC (“Paramont Defendants,”)
17 and Defendants Monks Family Trust, TEH Capital, LLC, Caproc III, LLC, WZ
18 Partners LLC, McLan Trust, Wild Rose Irrevocable Trust, Black Horse Holdings,
19 LLC, Phil Stoker, Diane Stoker, Scott O’Neil, and Dale Huish (“Paramont Investors”),
20 by and through their undersigned counsel, hereby stipulate and agree as follows:
21 WHEREAS, the parties are set to proceed to trial on March 11, 2024;
22 WHEREAS, Plaintiffs have asserted claims against Defendant Kevin Wolfe in
23 their Second Amended Complaint;
24 WHEREAS, Plaintiffs have agreed to dismiss Kevin Wolfe from this action
25 with prejudice;
26 WHEREAS, although Mr. Wolfe is not a resident of the state of California, he
27 has agreed to make himself available to testify at trial in person;

1 WHEREAS, Kevin Wolfe will not be required to attend every day of trial;
2 WHEREAS, Plaintiffs’ counsel has agreed to coordinate with Paramont
3 Defendants’ counsel as to when Mr. Wolfe will be needed to testify which shall not be
4 before Tuesday, March 12, 2024;
5 WHEREAS, Mr. Wolfe has agreed to waive his costs;
6 WHEREAS, the parties will concurrently file the Request for Dismissal and
7 this Joint Stipulation with the Court;
8 IT IS HEREBY STIPULATED, for the convenience of the Plaintiffs and
9 Paramont Defendants, and for the sake of judicial economy, the Plaintiffs, Paramont
10 Defendants, and Paramont Investors stipulate and agree that:
11 1. Mr. Wolfe will be dismissed from this lawsuit with prejudice;
12 2. Mr. Wolfe will make himself available to provide live testimony at trial;
13 3. The parties will coordinate the date and time for when Mr. Wolfe will
14 need to testify which shall not be before Tuesday, March 12, 2024;
15 4. It is not necessary for Mr. Wolfe to be present for every day of trial;
16 5. Mr. Wolfe has agreed to waive his costs;
17 6. The parties will concurrently file the Request for Dismissal and this
18 Joint Stipulation with the Court.
