IT IS HEREBY STIPULATED AND AGREED, by and between Plaintiff/Counterclaim
Defendant Robert T. Gold, DDS, P.C. d/b/a Smiles on Hudson (“Plaintiff”) and Defendant/
Counterclaim Plaintiff Demetra Malamatenios, DDS (“Defendant”) through their undersigned
counsel, who are authorized to enter into this Stipulation, as follows:
1. With the filing of this Stipulation, Plaintiff shall file an Amended Complaint with
additional factual allegations as contained in paragraphs 39-46 of the Amended Complaint;
2. Within seven (7) days of the filing of Plaintiff’s Amended Complaint, Defendant
shall file an Answer to the Amended Complaint and Amended Counterclaim against Plaintiff.
