DECLARATION OF DENNIS KIKER ISO DEFENDANTS’ REPLY TO MOTION FOR SANCTIONS

1 I, Dennis Kiker, declare as follows:
2 1. I am a Senior Attorney at DLA Piper LLP (US) (“DLA Piper”), attorneys for
3 Defendants Celeste White, Dr. Robert White, and the Valley Rock Foundation (“Foundation”), in
4 this action. I submit this declaration in support of Defendants Valley Rock Foundation’s and Dr.
5 Robert White’s Motion for Issue, Evidence, and/or Terminating Sanctions Against Plaintiff Lisa
6 Keith for Violating Court Order Compelling Responses to Discovery (the “Motion for
7 Sanctions”). This declaration is based on my personal knowledge. If called to testify, I could and
8 would testify competently to the matters herein.
9 2. I am a member of DLA Piper’s eDiscovery & Information Management group. I
10 have been practicing law since 1994 and have been exclusively practicing in the area of
11 eDiscovery since 2008. I was responsible in this case for, among other things, overseeing the
12 review and production of Defendants’ documents, and analysis of Plaintiff’s production, received
13 by DLA Piper on October 23, 2023.
14 3. I delivered Defendants’ document production and privilege log on May 23, 2023,
15 using DLA Piper’s secure file transfer system, ShareFile. The delivery was sent to the email
16 addresses of Plaintiff’s counsel, angie.lam@jkzllp.com and john@jkzllp.com. A true and correct
17 copy of this email is attached hereto as Exhibit 1 and incorporated herein by this reference.
18 4. On June 26, 2023, I received an email from Plaintiff’s counsel, Angie Lam, stating
19 that she was “unable to login to download the production and privilege log – please assist.” A true
20 and correct copy of this email is attached hereto as Exhibit 2 and incorporated herein by this
21 reference. Upon receiving the email, I logged into ShareFile to check on the status of the
22 production and found that it had been downloaded on May 24, 2023, by Arlyne Mata, who I
23 understand to be a practice assistant for Plaintiff’s counsel.
24 5. On October 23, 2023, Ms. Kizer advised me that Plaintiff’s counsel contended that
25 they were never able to download Defendants’ production and asked that I provide a new
26 download link with instructions for use. DLA Piper’s ShareFile is a temporary storage location for
27 secure file transfer and files are automatically deleted after 90 days. Because Defendants’
28 production was no longer available on ShareFile, I instructed our litigation support team to upload

1 again a copy of the production. I sent the new production by email to Ms. Lam at her email
2 address, angie.lam@jkzllp.com on October 25, 2023. A true and correct copy of this email is
3 attached hereto as Exhibit 3 and incorporated herein by this reference. On October 26, 2023, I
4 checked ShareFile to determine if the production had been downloaded, and saw that it had been
5 downloaded six times by A. Mata on October 25, 2023.
6 6. On October 23, 2023, I was asked by Ms. Kizer to oversee downloading and
7 processing of Plaintiff’s production from a ShareFile site associated with the Johnston, Kinney
8 and Zulaica LLP firm. I observed that the production appeared to be in native format and worked
9 with DLA Piper litigation support to download and process the documents into Relativity, a
10 document review database.
11 7. A list of the file names and associated metadata date fields for the 151 documents
12 in Plaintiff’s production is attached hereto as Exhibit 4 and incorporated herein by this reference.
13 The file names of all of the documents had been altered prior to production to incorporate a Bates
14 number starting (e.g., “L.KEITH.000874”). This is inconsistent with industry practice. (See The
15 Sedona Principles, Third Edition: Best Practices, Recommendations & Principles for Addressing
16 Electronic Document Production, 19 Sedona Conf. J. 1, 171 (2018) [“care should be taken when
17 handling native format files, and their accompanying metadata and other non-apparent data, to
18 avoid any inadvertent alteration”].)
19 8. Altering the file names is by definition altering one of the metadata fields
20 associated with the documents. This act resulted in further changes to other metadata fields,
21 including the “Date Last Accessed” of every document, and the “Date Created” and “Date Last
22 Modified” for most of the documents. See Exhibit 4.
23 9. Ms. Lam indicated in her Declaration, ¶15, that she received Ms. Keith’s
24 documents from her eDiscovery vendor and started review for relevance on 10/16/2023. This
25 indicates that she had not yet selected the documents for production, so the alteration of the file
26 names and other associated metadata fields must have occurred after Ms. Lam received the
27 documents from the eDiscovery vendor and before the documents were produced – in other words,
28 the documents must have been altered by Ms. Lam or someone in her firm.

I am a Senior Attorney at DLA Piper LLP (US) (“DLA Piper”), attorneys for 3 Defendants Celeste White, Dr. Robert White, and the Valley Rock Foundation (“Foundation”), in 4 this action. I submit this declaration in support of Defendants Valley Rock Foundation’s and Dr. 5 Robert White’s Motion for Issue, Evidence, and/or Terminating Sanctions Against Plaintiff Lisa 6 Keith for Violating Court Order Compelling Responses to Discovery (the “Motion for 7 Sanctions”). This declaration is based on my personal knowledge. If called to testify, I could and 8 would testify competently to the matters herein. 9 2. I am a member of DLA Piper’s eDiscovery & Information Management group. I 10 have been practicing law since 1994 and have been exclusively practicing in the area of 11 eDiscovery since 2008. I was responsible in this case for, among other things, overseeing the 12 review and production of Defendants’ documents, and analysis of Plaintiff’s production, received 13 by DLA Piper on October 23, 2023. 14 3. I delivered Defendants’ document production and privilege log on May 23, 2023, 15 using DLA Piper’s secure file transfer system, ShareFile. The delivery was sent to the email 16 addresses of Plaintiff’s counsel, angie.lam@jkzllp.com and john@jkzllp.com. A true and correct 17 copy of this email is attached hereto as Exhibit 1 and incorporated herein by this reference. 18 4. On June 26, 2023, I received an email from Plaintiff’s counsel, Angie Lam, stating 19 that she was “unable to login to download the production and privilege log – please assist.” A true 20 and correct copy of this email is attached hereto as Exhibit 2 and incorporated herein by this 21 reference. Upon receiving the email, I logged into ShareFile to check on the status of the 22 production and found that it had been downloaded on May 24, 2023, by Arlyne Mata, who I 23 understand to be a practice assistant for Plaintiff’s counsel. 24 5. On October 23, 2023, Ms. Kizer advised me that Plaintiff’s counsel contended that 25 they were never able to download Defendants’ production and asked that I provide a new 26 download link with instructions for use. DLA Piper’s ShareFile is a temporary storage location for 27 secure file transfer and files are automatically deleted after 90 days. Because Defendants’ 28 production was no longer available on ShareFile, I instructed our litigation support team to upload -2- DECLARATION OF DENNIS KIKER ISO DEFENDANTS’ REPLY TO MOTION FOR SANCTIONS CASE NO. 22CV001269 1 again a copy of the production. I sent the new production by email to Ms. Lam at her email 2 address, angie.lam@jkzllp.com on October 25, 2023. A true and correct copy of this email is 3 attached hereto as Exhibit 3 and incorporated herein by this reference. On October 26, 2023, I 4 checked ShareFile to determine if the production had been downloaded, and saw that it had been 5 downloaded six times by A. Mata on October 25, 2023. 6 6. On October 23, 2023, I was asked by Ms. Kizer to oversee downloading and 7 processing of Plaintiff’s production from a ShareFile site associated with the Johnston, Kinney 8 and Zulaica LLP firm. I observed that the production appeared to be in native format and worked 9 with DLA Piper litigation support to download and process the documents into Relativity, a 10 document review database. 11 7. A list of the file names and associated metadata date fields for the 151 documents 12 in Plaintiff’s production is attached hereto as Exhibit 4 and incorporated herein by this reference. 13 The file names of all of the documents had been altered prior to production to incorporate a Bates 14 number starting (e.g., “L.KEITH.000874”). This is inconsistent with industry practice. (See The 15 Sedona Principles, Third Edition: Best Practices, Recommendations & Principles for Addressing 16 Electronic Document Production, 19 Sedona Conf. J. 1, 171 (2018) [“care should be taken when 17 handling native format files, and their accompanying metadata and other non-apparent data, to 18 avoid any inadvertent alteration”].) 19 8. Altering the file names is by definition altering one of the metadata fields 20 associated with the documents. This act resulted in further changes to other metadata fields, 21 including the “Date Last Accessed” of every document, and the “Date Created” and “Date Last 22 Modified” for most of the documents. See Exhibit 4. 23 9. Ms. Lam indicated in her Declaration, ¶15, that she received Ms. Keith’s 24 documents from her eDiscovery vendor and started review for relevance on 10/16/2023.
