3 THAT Plaintiff Justin Carino hereby requests that the Court take judicial notice of the following

PLAINTIFF’S REQUEST FOR JUDICIAL NOTICE
1 Evidence Code § 453 provides that a trial court must take judicial notice “of any matter
2 specified in Section 452” if a party requests judicial notice of a matter, gives the opposing party
3 sufficient notice (Evid. Code § 453, subd. (a)), and provides the court sufficient information to take
4 judicial notice of the matter Evid. Code § 453, subd. (b).”
5 The exhibits Plaintiff requests this court to take judicial notice of (trial court decisions of the
6 Superior Court of California) fit squarely within Evidence Code § 452. “Judicial notice may be taken
7 of ... [r]ecords of any court of this state.” Evid. Code § 452(d); Day v. Sharp (1975) 50 Cal. App. 3d
8 904, 914 (a court may properly take judicial notice of the records of any court of record of any state
9 of the United States).
10 Thus, the Court should take judicial notice of Exhibits 4, 5, 6, 7, 8 and 9 to the Bollinger
11 Declaration, filed concurrently herewith, which are records from cases filed in the California Superior
12 Court for the counties of Kern, Kings, Los Angeles and Stanislaus.
13 In seeking judicial notice of the above-listed Exhibits, Plaintiff has provided Defendant with
14 sufficient notice of this request and has furnished the Court with sufficient information to enable the
15 Court to take judicial notice. Accordingly, judicial notice of the above listed Exhibits, matters
16 specified in Evidence Code section 452, is proper pursuant to Evidence Code section 453.
17 Therefore, based on the foregoing authorities, Plaintiff respectfully requests that this Court
18 take judicial notice of the above listed Exhibits and that they be considered by the Court in ruling on
19 Plaintiff’s Motion.
