19 NURSERY dba COLORAMA (hereinafter collectively “Defendants”) seek an Order from the Court
20 continuing the trial, currently set for January 9, 2023 t0 March 27, 2023, or a convenient date
21 thereafter. Good cause for a continuance exists because Plaintiff BRIAN MAHAFFEY (hereinafter
22 “Plaintiff Brian”) was recently diagnosed with visual disturbances and will need further evaluation.
23 This information was just recently learned at the deposition of Plaintiff Brian’s neuropsychologist,
24 and counsel for Plaintiff Brian was aware ofthis at least 2 weeks prior t0 the deposition and did not
25 disclose it t0 Defendants.
26 Additional good cause for a continuance exists because PlaintiffBrian will be evaluated by
27 a cardiologist on December 29, 2022, upon recommendation of his neurologist. Defendants may
28 need t0 retain an expert cardiologist and conduct an Independent Medical Examination 0f Plaintiff

Brian with their retained cardiologist. Defendants learned 0fthis upcoming evaluation on December
20, 2022.
Lastly, good cause exists because co-lead trial counsel, Kimberly Oberrecht, is beginning
a trial in San Diego County 0n January 6, 2023, and therefore will be unavailable for the current trial
date of January 9, 2023.
