PLAINTIFFS’ REPLY TO MOTION TO COMPEL
DEFENDANTS TO RESPOND TO REQUESTS FOR PRODUCTION AND
INTERROGATORIES TO DEFENDANT INLAND DREDGING COMPANY, LLC.
Plaintiffs Richard Villnave and Darius Stewart file this Motion to Compel Defendant Encore
Dredging Partners, LLC. and Defendant Inland Dredging Company, LLC. (collectively
“Defendants”) and respectfully urge this Court to GRANT the Motion to Compel.
• Defendants’ are wholly disregarding the Texas Rules of Civil Procedure and seek to
hide, delay, and make baseless accusations and refuse to answer discovery.
• Plaintiffs are entitled to responses to requests for production and interrogatories.
Defendants completely failed to provide responsive information.
• Defendant Encore Dredging Partners, LLC's responses were due March 2, 2023.
• Defendant Inland Dredging Company, LLC's responses were due April 28, 2023.
• Defendants were properly served with requests. No responses have been served.
Defendants have waived all objections and should be ordered to respond in full.
Plaintiffs hit a dredge pipe that was not marked. Defendants investigated the damages and
offered to pay for the property damage to the boat only but only on their terms. Plaintiffs filed suit,
and served discovery on the Defendants for personal injuries. Defendants completely refuse to
respond. Plaintiffs are entitled to responses so that Plaintiffs can adequately respond to pending
motions. See Exhibits A, B, and C. This is gamesmanship. There is no emergency except to the
extent that Defendants need Court intervention to respond to basic discovery. Plaintiffs ask that
the Court reset the pending motion for summary judgment after a time that discovery has been
responded to, and allow Plaintiffs to take depositions and put forth its case, and give Plaintiffs a
full opportunity to respond.
Plaintiffs’ requests are reasonable and seek only what is reasonably calculated to lead to
the discovery of admissible evidence.
CONCLUSION
Accordingly, Plaintiffs pray that the Court grant Plaintiffs’ Motion to Compel, and all other
relief to which they may be entitled.
