NOW COME Defendants, Encore Dredging Partners, LLC and Inland Dredging
Company, who respectfully request that this Court dismiss the claims of plaintiffs, Richard
Villnave and Darius Stewart, with prejudice. Mr. Villnave and Mr. Stewart have falsely claimed
that they struck the dredge discharge pipeline attached to the dredge RANGER, a dredging vessel
owned and operated by Encore Dredging Partners, LLC and Inland Dredging Company. However,
empirical data obtained from Mr. Villnave’s duck boat conclusively disproves this allegation and
demonstrates that the plaintiffs have no claim for damages against these defendants, all as more
fully explained in the attached Memorandum in Support.
