1 Plaintiff JOHN BOUDREAU ("Plaintiff) and Defendant PRIMERITUS FINANCIAL
2 SERVICES, INC. ("Defendant") (together, the "Parties") hereby submit the following Joint Case
3 Management Conference Statement for the Case Management Conference on July 29, 2021, at 1:30
4 p.m. in Department 41.
5 I. STATUS OF THE CASE
6 Plaintiff filed this Class Action matter on December 27, 2018. Plaintiffs First
7 Amended Complaint (filed April 12,2019) alleges seven causes of action: (1) Failure to Pay Minimum
8 Wage; (2) Failure to Timely Pay Wages (Waiting Time Penalities); (3) Failm-e to Provide Rest
9 Periods; (4) Failure to Provide Meal Periods; (5) Failure to Provide Accurate Wage Statements; (6)
10 Violation of the Unfair Competition Law; and (7) Civil Penalites under PAGA. Defendant seeks to
11 represent himself and other similarly situated employees of Defendant Primeritus.'
12 The parties reached a tentative settlement of the action on April 6, 2021, and thereafter
13 formalized and signed a long form settlement agreement.
14 Plaintiff filed the Motion for Preliminary Approval of Class Settlement ("Motion") and
15 the hearing the Motion was held on July 29, 2021. The Court granted Plaintiffs Motion on July 29,
16 2021.
17 The Notice of Proposed Class Action Settlement has been mailed to Class Members
18 and the last date to submit opt-outs and to submit objections is October 12, 2021.
19 The Final Approval Hearing is scheduled for December 3, 2021, at 9:30a.m. in
20 Department 41.
21 II. SUGGESTIONS FOR CASE MANANAGEMENT
22 Continue or vacate the Case Management Conference and set a further Case
23 Management Conference, if necessary, for a date after the Final Approval Hearing.
