1. Petitioner is the settlor of the Wilfred W. and Imogene J. Foreman Family Trust
which was created on October 18, 1995 by written declaration of trust. A copy of the
Trust is attached to this petition as Exhibit ‘A.’
2. This County is the proper venue for this petition under Probate Code Section
17005(a) because the principal place of administration of Trust is located under Probate
Code Section 17002. The former trustee ofthis Trust, Rachel Delfin, resides in this
county and has conducted the day-to-day activities of the Trust here.
3. On June 23, 2021, a vacancy occurred in the office of the trustee due to the
resignation of Rachel Delfine who was named in the Sixth Amendment to the

Declaration of Trust executed on May 20, 2021.

4. The trust instrument requires that a vacancy in the office of Trustee be filled, and

the instrument neither provides a practical method of appointing a Trustee, nor name a

person to fill the vacancy.

5. By an instrument in writing, Rachel Delfine, the former Trustee has nominated

the Office of the Public Guardian as successor trustee. A true and correct copy of the

resignation is attached as Exhibit Petitioner has consented and nominated the

Office of the Public Guardian by verification of this document and by statements made
18
orally before the Court on June 21, 2021 on the related matter of EAPSSBZ100016.

6. A bond is not required as the Successor Trustee is the Office of the Public

Guardian.

guardianship cases. However, the Court makes this disclosure of an employment relationship
between an investigating agency and the Court’s first degree relative as required by California
Code of Judicial Ethics.
