Plaintiff has filed an ex parte application to strike defendant’s separate statement filed in support of defendant’s motion to compel further responses to (1) special interrogatories, (2) requests for admission, and (3) form interrogatories – employment law. In essence, defendant filed a separate statement in support of that motion to compel further responses on May 25, 2021, with a proof of service stating that it was served by e-mail on plaintiff’s counsel on that date, but plaintiff’s counsel claim that they did not receive service of the separate statement. The court denies plaintiff’s ex parte application to strike defendant’s separate statement in support of defendant’s motion to compel further responses, filed May 25, 2021. But the court further orders: (A) The hearing on defendant’s motion to compel further responses to (1) special interrogatories, (2) requests for admission, and (3) form interrogatories – employment law is continued from October 14, 2021 to January 21, 2022, at 10:00 a.m., in Department 53; (B) Defendant shall re-serve its separate statement filed in support of that motion on plaintiff’s counsel no later than October 15, 2021, and file a proof of service with the court no later than October 22, 2021; Minute Order Page 1 of 2
