Plaintiff made a 13 workers’ compensation claim, which Viacom paid. Viacom moves for leave to intervene in the action at 14 this time. 15 16 Labor Code §§3852 and 3853 make clear that an employer against whom a claim for worker's 17 compensation damages was made may join in an action against a third party arising out of the incident for 18 which the worker’s compensation payment was made. §3850(b) defines “employer” to include the 19 employer's insurer. 20 ry 21 The motion is unopposed and granted.
